Terry began practicing law in 1982, yet shifted his focus to criminal law defense in 1996, joining the federal Criminal Justice Act Panel of attorneys for the federal District of Wyoming. Since then, Terry has devoted his practice to providing the "guiding hand" of counsel to federal defendants charged with serious crimes. Terry was appointed the CJA Panel Representative for federal District of Wy

oming in January 2005 and continued as the Panel Rep until December 2013. Terry also was a past member of CJA Standing Committee for federal District of Wyoming. Both Emily and Terry were part-time Wyoming Assistant Public Defenders beginning December 2013 (Terry resigned that position July 2015, as a court-imposed requirement to continue representing Dale Eaton; Emily resigned that position April 2016). Focus of practice is federal and state criminal defense and 2254 federal capital habeas. Terry was on legal team that recently succeeded in obtaining vacating of death penalty and murder conviction in James Harlow capital habeas (Wyo. No. 05CV039-B) and on legal team that also recently succeeded in obtaining vacating of death penalty in Dale Eaton capital habeas (Wyo. Johnson's order can be read here:

Emily, as lead counsel, recently obtained "not guilty" jury verdict in State of Wyoming v. Timothy Larimore, involving felony theft charge alleging store manager stole company cash bank deposit. Terry obtained Tenth Circuit reversal in United States v. Brown, 529 F.3d 1260 (10th Cir. 2008) (UCMJ Courts Martial for child po*******hy possession not a “prior conviction” under federal child po*******hy statutes). Terry also obtained federal jury trial “not guilty” verdicts in United States v. Nowlin (Wyo. No. 06CR242-D) (charged with assault with serious bodily injury) and United States v. Castro (Wyo. No. 02CR077-J) (charged leader of methamphetamine conspiracy). Terry recently also obtained Order granting habeas relief under 28 U.S.C. § 2255 in Medina-Gonzalez v. United States, vacating both the conviction and the 168-month sentence, and ordering release of Mr. Medina (Wyo. Nos. 12CV105-F and 10CR127-F) (Fifth Amendment Brady violations preventing full and fair hearing on Fourth Amendment claims). Terry was appointed by Tenth Circuit in 2011 to Committee to Assess Candidates for the position of Federal Public Defender for the Districts of Colorado and Wyoming; previously appointed to non-competitive review process led to that Federal Defender’s reappointment to a second four-year term in 2007. Terry was a guest lecturer Wyoming Law Enforcement Academy, Fourth Amendment Search and Seizure, August 2009 through August 2015. Terry obtained his JD from the University of Wyoming in 1982, and his BS from Virginia Tech in 1979. Emily obtained her JD from the University of Wyoming in 2013, and her BS from Arizona State University in 2010. Brian obtained his JD from the University of Wyoming in 2012. Emily, Brian and Terry continue, today, to provide each and every federal or state criminal defendant they represent, the "guiding hand of counsel" in all matters of their legal defense.

Acquitted, following close of the state prosecutor’s case!!!

“ . . . the Court has considered the motion and made findings on the record, incorporated herein, and for the reasons stated finds that the evidence presented by the government in its case-in-chief is insufficient to sustain a conviction for the offenses charged herein, therefore,

"Not guilty" - all defendants, all counts!! United States of America v. Barrus, et al., 19CR171-ABJ. Jury's verdicts returned March 10, 2022, following ten days of trial. Our clients were told by the United States Attorney's Office in April of 2018 they were "targets" of a federal prosecution, formally indicted September 2019, and finally tried before their jury beginning February 28, 2022. Approximately 200,000 pages of discovery (received in an "electronic" format that was "packaged" as if the once-organized paper documents had been thrown from the top of the eight-story federal building in which our clients would be tried. And that was just the beginning of a long and sorry tale of the lengths a couple of federal prosecutors in Wyoming would be willing to go in their unrelenting efforts to secure convictions in this case.

Once again, I have been so lucky to work with an incredible team of great lawyers, Emily Harris, Jamie Woolsey, Ian Sandefer, Ed Wall and Alexander Ramos. Incredible dedication and effort by all.
