Children do not simply get to decide, because they are children, not parents. However, in New Jersey, a newly changed custody statute emphasizes a child's preference in custody decisions. The age of the child, their maturity level, and other facts are important to how much weight a Judge will give the child's preference, and that is only of many factors that the Court must consider.

Now it's time for the broad overview, definitely oversimplified, of a litigated divorce in Pennsylvania. (If you missed New Jersey's last week, it's pinned to the grid!).

Can you try to work things out or settle your case before filing a Complaint? Yes (and we strongly recommend this)! Can you go to mediation at any time during this process, even before filing? Yes! Are divorce cases likely to go to Trial? No! Is there more you need to know about a Pennsylvania divorce? Of course! This is just an overview of the typical main steps in a litigated case. Every case is different and there are tons of nuances that we could not possibly capture in a graphic. There is no race to (or away from, thanks AI-generated artwork) the Courthouse in divorce. A lot of people think "Defendant" is bad, and that can be true in other Courtrooms where you would not want to find yourself as Defendant. In Family Court in general (other than domestic violence cases), being the Defendant just means the other person filed first, whether that is for divorce, custody, or support. There is no meaningful advantage to filing first, although there can be other reasons someone might want to.

Custody disputes are not about watching the clock, one-upping, or keeping score. The closest thing to "winning" custody is coming to an agreement that serves the best interests of children, reduces their stress, and, where possible, minimizes conflict between the parents.
