Please know this. Everyone in New Jersey should be aware that subacute rehab residencies/admissions in “long term care licensed facilities”, such as the rehab section of say, Care One, fall under the nursing home laws in New Jersey. This is very important, because it provides very strict protections and statutory Nursing Home Act Rights. That is why a trial lawyer friend of mine and Rich Talbot as well, have been able to obtain verdicts for violations of those NHA rights against Care One nursing homes in New Jersey, for subacute rehab residents. The Department of Health regulates and conducts the same surveys of both the subacute and long term sections of any healthcare facility for which it issues a long term care license. That means it is a nursing home, regardless of length of admission. By law, they are required to notify the residents of these rights.
Finally, please note that regardless of payment source, once someone simply APPLIES to a long term licensed facility in this state, the rights under the Nursing Home Act and all the protective laws apply. See:

4. Except as otherwise provided in this act, the provisions of P.L.1976, c.120 (C.30:13-1 et seq.) and section 3 of P.L.1997, c.241 (C.30:13-3.1) shall apply to any applicant for admission to a nursing home or any resident of the facility, whether the applicant or resident is eligible for benefits under the Medicare or Medicaid program or is a private pay patient, or may in the future convert from a private pay patient to a Medicare or Medicaid patient.
