On June 15, 2023, the United States District Court for the District of New Jersey issued an Opinion in favor of Hagner & Zohlman, granting their client partial Summary Judgment against Hartford Life and Accident Insurance Company who had denied the client's claim for Long Term Disability Benefits under the Employee Retirement Income Security Act of 1974 ("ERISA"). The Court made a specific finding that "Defendant's decision [was] not supported by substantial evidence" and remanded the claim so that "an appropriate analysis" may be conducted. While ERISA claims are always uphill battles against an "arbitrary and capricious" standard, this Opinion represents yet another instance where the attorneys at Hagner & Zohlman have demonstrated that an insurance company’s decision was arbitrary and capricious, i.e., without reason, unsupported by substantial evidence, or erroneous as a matter of law.

On March 18, 1963, unanimously decided Gideon v. Wainwright, one of the landmark cases of the modern era.

"If an obscure Florida convict named Clarence Earl Gideon had not sat down in prison with a pencil and paper to write a letter to the Supreme Court; and if the Supreme Court had not taken the trouble to look at the merits in that one crude petition among all the bundles of mail it must receive every day, the vast machinery of American law would have gone on functioning undisturbed. But Gideon did write that letter; the court did look into his case; he was re-tried with the help of competent defense counsel; found not guilty and released from prison after two years of punishment for a crime he did not commit. And the whole course of legal history has been changed."
