I’m sure you have a daily routine. Day in and day out, it’s the same thing, over and over. Maybe you head straight to work or perhaps you have kids to drop off at daycare or school. You have responsibilities and hobbies that are integral parts of your life. While to some, your daily life may seem boring and repetitive, to you, it’s your comfort zone. The one thing that never changes.

Until it does.

Did you know South Carolina ranks #2 in the nation for DUI fatalities? Now that Christmas is over, most people are getting ready to bring in 2026 with family, friends, and late night parties.

From mid to late December until early January, we often see an uptick in roadblocks and law enforcement saturation. These are specifically targeting drivers who are operating vehicles while under the influence.

A few pointers on avoiding a DUI or DUAC charge:

1. DO NOT DRINK AND DRIVE.

2. Before attending parties or gatherings, always have a designated driver on standby.

3. Even if you’ve only had a couple of drinks, if you are stopped, whether it be for bad driving, a burnt out tag light, or going through a road block, you could still blow higher than is legal. Keep in mind, if you blow .15 or higher, or refuse to blow, your license will be suspended.

If you are in an accident and someone suffers great bodily injury or killed, your DUI could be upgraded to Felony DUI. These offenses can carry from 30 days to 15 years in prison for Felony DUI resulting in great bodily injury or 1 to 25 years for Felony DUI resulting in death. This is in addition to fines, drivers license suspensions and ignition interlock device requirements.

If you have a commercial driver’s license, you are held to a higher standard and your penalties could be far greater than a “normal” licensed driver, even if the DUI was received in your personal, non-commercial vehicle.

Christmas is less than a week away and that means more traffic even in the most rural areas. People are out and about traveling to see family, attending parties or getting some last minute shopping in.

What does more traffic mean? An increase in motor vehicle accidents. With today’s technology advancement, people are more distracted than ever with GPS and cell phones. Not to mention, the kids in the back asking “Are we there yet?”

While most people think “it could never happen to me,” that’s just not true. You could become a statistic.

Car accidents and the repercussions don’t end once the roadway is clear. You could suffer from injuries that aren’t noticeable for days, and the adrenaline has worn off. Remember these few things if you find yourself in an accident this holiday season:

1. Call 911 and make sure a police report is filed.

2. Get medical care immediately — even if you feel “okay”.

3. Take photos of the vehicles, scene, and any injuries.

4. Exchange information with all drivers and witnesses.

5. Do NOT give a recorded statement to the insurance company right away.

6. Talk to a personal injury attorney before accepting any settlement.

DUI vs DUAC

In South Carolina, a DUI and DUAC are not the same.

According to South Carolina Code § 56-5-2930 a DUI or Driving Under the Influence is defined as:

“It is unlawful for a person to drive a motor vehicle within this State while under the influence of alcohol to the extent that the person's faculties to drive a motor vehicle are materially and appreciably impaired, under the influence of any other drug or a combination of other drugs or substances which cause impairment to the extent that the person's faculties to drive a motor vehicle are materially and appreciably impaired, or under the combined influence of alcohol and any other drug or drugs or substances which cause impairment to the extent that the person's faculties to drive a motor vehicle are materially and appreciably impaired.”

Many believe a DUI is for alcohol only. This isn’t true. As you can see above, South Carolina law mentions being under the influence of either alcohol and/or drugs. This can include prescription medication or illegal substances. Even if your BAC is 0.00%, you can be charged with a DUI. If you are under the influence of any substance that affects your ability to safely operate a motor vehicle, you can be charged with a DUI.

So, what’s DUAC, or Driving with an Unlawful Alcohol Concentration? South Carolina Code § 56-5-2933 defines DUAC as:

“It is unlawful for a person to drive a motor vehicle within this State while his alcohol concentration is eight one-hundredths of one percent or more. A person who violates the provisions of this section is guilty of the offense of driving with an unlawful alcohol concentration.”

Let’s say you are on the way home from the Mexican restaurant after having a margarita with your friends. Your driving is great but you happen upon a roadblock. You speak with the officer when asked the normal questions (ie. Where are you going? Where are you coming from?) and they smell alcohol on your breath. The officer administers the Standardized Field Sobriety Tests and you believe you passed, but you are still arrested. You don’t believe you are guilty of a DUI so when you get to the BAC room, you agree to blow. The test results are .08%. At this point you can be charged with DUAC.

CDLs and DUIs in South Carolina

🔹 Lower BAC Limit
CDL drivers are held to a stricter standard:
• 0.04% BAC in a commercial vehicle = DUI
• Even “just a couple drinks” can put your career at risk.

🔹 Personal Vehicle? Still Counts.
A DUI or test refusal while driving your own car can still suspend your CDL — and your livelihood.

🔹 Serious CDL Penalties
• 1-year CDL disqualification for a first DUI/DUAC or refusal
• 3 years if hauling hazardous materials
• Lifetime ban for a second offense

🔹 Refusing the Test Won’t Save You
A refusal triggers the same CDL disqualification as a DUI.

🔹 Employers Are Watching
Most trucking companies will not keep or hire a driver with a DUI on their CDL record.

🔹 An Arrest Is NOT a Conviction
CDL cases can be challenged — from field sobriety tests to breath-test procedures. You still have rights.
