What a Maine OUI Plea Can Do to a MA Driver’s Record ⚖️

A Maine OUI plea follows you home. Massachusetts uses "Melanie’s Law" to count out-of-state offenses, meaning a first offense in Maine could trigger much harsher penalties at the MA RMV.

Don't rush a plea without a strategy. Protect your license and your future by understanding how both states will view your record. 👇

🚨 New Hampshire Reckless Driving Law Update

As of January 1, 2026, New Hampshire increased penalties for drivers accused of going 100 mph or more. Under the updated law, driving at or above 100 mph can now be treated as reckless driving, even without other dangerous conduct alleged.

That means a first offense can carry a mandatory 90-day license suspension, higher fines, and serious long-term consequences for your driving record.

This is especially important for Massachusetts drivers who receive a reckless driving charge in New Hampshire, since out-of-state license consequences can become complicated quickly.

Read the full update from Attorney Shane Goudas to learn what changed, what penalties drivers may face, and how Bowser Law Firm can help.

What Happens to Your MA License After a NH DUI Refusal?

A New Hampshire DUI refusal creates two problems: the NH criminal case and the Massachusetts Registry consequences. The MA RMV doesn't ignore out-of-state offenses—your license back home could be suspended or revoked once they catch up.

Don't be blindsided by a reciprocity notice. Read our full guide to understand how to protect your right to drive in both states. ⚖️👇

Stopped for an OUI? Your Rights Regarding Field Sobriety Tests

In MA, ME, or NH, you aren't required to perform field sobriety tests. While you must provide your license and registration, you can decline these subjective tests to prevent the police from gathering damaging evidence against you.

Why You Must Stay Silent During a Massachusetts OUI Stop

The worst thing you can do during an OUI stop is talk to the police about your night. While you must provide basic info like your DOB during booking, you should never discuss where you've been or what you drank. Don't jeopardize your defense by being a "Chatty Patty."

If you are a Massachusetts resident charged with a DUI in New Hampshire, the MA Registry of Motor Vehicles uses a lifetime lookback provision under Melanie's Law to calculate your license suspension, even if the NH charge is a first offense. While New Hampshire only has a 10-year lookback, Massachusetts will use your entire history of drunk driving offenses to calculate the reciprocal suspension. A second lifetime offense means a two-year loss of license, a third is eight years, a fourth is 10 years, and a fifth lifetime offense can result in a lifetime suspension. It is critical to hire an attorney who understands both NH DUI law and the complexities of MA reciprocity.

In a New Hampshire DUI case, you will not receive a copy of the police report or the arrest report prior to your scheduled arraignment. Your lawyer will request "discovery"—all the evidence the prosecution has against you—at the same time they waive the arraignment. Discovery includes 911 calls, witness statements, cruiser camera, body worn camera, booking video, and breath test information.

Got a DUI in New Hampshire? Your lawyer can attend the arraignment and enter a "not guilty" plea for you, so you don't have to miss work or family time! A qualified NH DUI defense lawyer will always waive this appearance.

If you have a New Hampshire DUI, you can challenge the six-month administrative license suspension through a hearing at the New Hampshire DMV. Your lawyer must send a written request for the hearing within 30 days after the arrest. This administrative hearing is critically important because the arresting officer has to appear, be under oath, and answer questions about the grounds for the arrest. The sworn testimony and transcript from this hearing can be used later to defend the DUI charge in a courtroom. A qualified New Hampshire DUI defense lawyer will always request this hearing.
