☀️It's June, which means our high school adult graduates have left high school and are entering adulthood. When your child turns 18, you no longer have automatic authority to access medical, financial, or educational information, even in an emergency.

Essential legal documents can ensure you are able to step in and help when it matters most:

• HIPAA Authorization — allows access to medical information
• Medical Power of Attorney — allows you to make healthcare decisions
• Durable Financial Power of Attorney — allows management of finances if they cannot
• FERPA Authorization — allows access to college records
• Living Will / Advance Directive — outlines healthcare wishes

Without these documents, families may face court intervention just to help their own child.

If your family has an 18 year old or soon to be college student, now is the time to plan.

An estate plan is not a one time task. Major life events should trigger a review, including:

• Marriage or divorce
• Birth or adoption
• Death of a beneficiary or decision maker
• Significant financial changes
• Moving to a new state

Regular updates ensure your plan reflects your current wishes and your state's laws.

If you pass away without a will, the court appoints an administrator to manage your estate. This person may not be who you would have chosen, and the process can take longer and cost more.

A properly executed will allows you to select your own executor and provide clear instructions for your family.

Your named executor, trustee, and healthcare decision makers should know where to find your documents and how to access them. You don't need to share every detail, but accessibility is critical in an emergency.

Not every child is the right fit to serve as executor. This role requires organization, time, financial responsibility, and the ability to navigate family dynamics during a difficult season. Parents may choose one child to avoid conflict, select the most geographically available child, or appoint the person best equipped to handle legal and financial matters.

If you have questions about choosing the right executor for your estate, thoughtful planning now can prevent complications later.

Marriage equality provides important protections, but comprehensive estate planning remains essential for all families. Documents such as wills, powers of attorney, and healthcare directives ensure your chosen decision makers — not default state rules — control what happens if you become incapacitated or pass away.

We are committed to helping every family protect what matters most. 🌈
