In today’s post, I’m going over what a prenuptial agreement is: A prenuptial agreement is a legal contract created by two people before marriage. It allows both individuals to openly disclose what they own and agree on how finances, property, and debts will be handled during the marriage and in the event of divorce or death.

A "prenup" can help protect premarital assets, outline financial responsibilities, and provide clarity on how assets and debts would be divided if the marriage ends.

A well-crafted "prenup" doesn’t mean you’re expecting the worst; it means you’re starting your marriage with transparency, clear expectations, and a plan to protect both parties’ interests.

What Is the Mediation Process?
The Mediation process is guided by a neutral mediator to help the parties avoid a costly and length trial.

- First, each party will meet with their respective attorneys to discuss their goals on issues in divorce, custody, support, alimony, and other family law matters.
- Then, the mediator will meet with each party separately in the presence of their respective attorneys to negotiate on a resolution that all parties can agree on. The mediator does not offer legal advice. Instead, they help the parties come to an agreement on their issues.
- Finally, once an agreement has been reached, the parties will enter into a binding agreement, which will be drafted by the parties' attorneys.

In Today's post I am going to share 3 different Factors Influencing Alimony Decisions:

1. Financial Needs and Resources
Tennessee courts assess both spouses’ income, expenses, assets, and earning potential to determine fair alimony. Judges also consider factors such as age, health, and employability to evaluate economic disparity. The objective is to help the lower-earning spouse maintain a standard of living comparable to the marriage while ensuring support obligations are reasonable.

2. Duration of the Marriage
The length of the marriage significantly impacts alimony decisions. Longer marriages typically result in greater or longer-lasting support due to deeper financial interdependence, while shorter marriages often lead to limited or no alimony. Courts use this factor to set realistic and equitable expectations for post-divorce financial independence.

3. Contributions to the Marriage
Tennessee courts recognize both financial and non-financial contributions, including homemaking and childcare, when determining alimony. These roles are viewed as integral to the marital partnership and may have supported the other spouse’s career advancement. By accounting for all forms of contribution, courts aim to ensure equitable financial outcomes after divorce.
