Like so many people, I grew up listening to her music, but what has always stood out to me even more was the person behind the music-her kindness, generosity, humor, and the way she used her success to make a difference in the lives of others. Dolly didn’t just build a remarkable career. She built a remarkable legacy. And that’s something I think about often in my own work. A legacy isn’t just about what we leave behind. The estate of former Zappos CEO Tony Hsieh has become the center of an unusual probate dispute after a previously unknown will surfaced more than four years after his death. Hsieh died in 2020, and his estate had been administered on the understanding that he died without a will. The newly surfaced document, reportedly dated 2015, could affect the distribution of an estate valued at more than $500 million.

The dispute has since deepened, with Hsieh’s family challenging the document and alleging that it is a forgery. Questions surrounding its origin, signatures, witnesses, and authenticity remain part of the ongoing legal proceedings.

During Make-A-Will Month, the case is a reminder that preparing a will is only one step. Proper ex*****on, secure storage, and ensuring important estate planning documents can be located when needed will help reduce uncertainty later.

Having a trust does not automatically mean a will is no longer necessary. A trust controls assets that have been properly transferred to the Trust. If assets are left outside the Trust, it is absolutely necessary to have a Pour-Over-Will. You can't have a Revocable Trust without a Pour-Over-Will. But you can have a Will without a Revocable Trust.

In many estate plans, the two documents are designed to work together. A “pour-over” will, for example, may direct certain remaining assets into a trust after death. A will can also address important matters that a trust may not cover, including naming guardians for minor children.

This Make-A-Will Month, it is worth reviewing whether your will, trust, beneficiary designations, and other estate planning documents still work together and reflect your current wishes.

If it has been a while since your estate plan was reviewed, now is the time to take another look.

August is Make-A-Will Month, which is a good time to review whether your will still reflects your current life, family, assets, wishes, and goals.

✅ Review your beneficiaries: make sure the people or organizations named still reflect your wishes.
✅ Revisit guardians for minor children: consider whether your choice still fits your family’s circumstances.
✅ Consider major life changes: marriage, divorce, births, deaths, relocation, or financial changes may affect your plan. How do any of these changes affect your Will and planning.
