COVID-19 PANDEMIC UPDATE

Today, Mecklenburg County enacted a Stay-at-Home Order that begins at 8:00 a.m. on March 26, 2020 and lasts until April 16, 2020. This means that only essential businesses are allowed to operate at all. Fortunately, legal services are a part of those essential services. We will continue to conduct closings as long as the Registers of Deeds offices and Clerk of Courts offices are open and allowing us to conduct full title searches.

We are working remotely as necessary and the office will be closed to clients. Real Estate closings and refinances will be limited to mail-away closings. We will happily schedule virtual visits with purchasers to go over your loan documents prior to signing with the notary. We have access to mobile notaries that are well versed in the closing process to assist in your closing.

If you are in need of services in any of our practice areas, please do not hesitate to reach out to us and together we can come up with a plan to move forward so that we are all prepared when this passes.

We sincerely appreciate all the patience and flexibility you have shown during the past weeks and know that we will come together as a community to continue moving forward. We are all in this together. We will continue to monitor the COVID-19 situation and will follow guidance from public health officials and government agencies, so we can continue to support our customers and communities as needed.

COVID-19 PANDEMIC UPDATE

Dear valued clients, realtors and friends:

Out of an abundance of caution and with the recent CDC and State recommendations with regards to social distancing we are implementing the following additional modifications to our plan released yesterday:

1) We are implementing an Appointment Only Policy. If you do not have a scheduled appointment, please call or email our office as we will not be able to accommodate walk-ins. As stated in prior statements we are limiting our office hours and working from home as much as possible.

2) AVOID LINGERING IN THE CONFERENCE ROOMS. Prior to entering the office, please call ahead to facilitate entering the office hands-free and being immediately directed to a conference room. We apologize for any prolonged wait in your car.

3) CLOSINGS. The buyer(s) and/or seller(s) are the only people who should be physically present in our office for closings or appointments. Bring only the necessary signers to the table. Buyers and Sellers should take particular care to avoid bringing their children to closing.
a. SELLERS. We will be limiting in-office appointments for sellers. Sellers are encouraged to sign their seller documents outside of our office and to overnight or hand-deliver the original, notarized documents for closing. This will help to reduce overall traffic and contact.
b. REAL ESTATE AGENTS & LENDERS. Please consider phone conferencing or facetime/skype attendance, instead of being physically present. Lenders, additional family members, and other third parties will not be allowed to attend closings or appointments.

4) LENGTH OF CLOSINGS. Our office prides itself on our attorneys’ friendliness and desire to educate buyers about the closing process and to explain all closing documents. At this time and in order to shorten the amount of time of closing (and thus lessen exposure), our attorneys will quickly review all documents at closing and will attempt to have buyers in and out of the office within 20 minutes. If you would prefer to read your loan package in advance, please contact your paralegal who can email you the package prior to closing.

5) CASH CLOSING. All cash closings (eg not involving a loan) will now be handled remotely without a physical in-office closing).

6) NO PHYSICAL CASH. Physical cash is handled by multiple people every day and can be an opportunity to circulate many germs, not just COVID-19. Please do not present physical cash at the closing, but defer to bank checks and wires, where possible.
a. Increased use of wires requires additional security around that process.
b. If sending a wire, please call to confirm the wiring instructions with our office prior to sending.
c. Do not EVER rely on email for the wiring instructions or our contact information.

We strongly recommend all parties complete the signing of their closing documents remotely, either with the use of a mobile notary service or by signing with your own notary. We will be available via telephone to explain your documents.

This is a fluid situation and we anticipate making additional changes to our policies in the coming day. However, we are creative and resourceful and are sure we can continue to provide the same friendly, professional services to all our clients, realtors and friends so long as the local Register of Deeds Offices are open and operating.

COVID-19

Dear valued clients, realtors and friends:

We are striving to maintain some type of normalcy here at Millsaps & Bratton throughout the upcoming weeks due to the Covid-19 Pandemic. For the protection of our staff members, valued clients and their families, we do need to make some modifications to our daily operations to ensure everyone’s safety. We want to assure you that we are closely following the Center for Disease Control’s (CDC) guidelines and have put the following measures into place to ensure that we can continue to provide services in the safest possible manner.

If you are currently scheduled for a closing we are prepared to move forward as planned, however, we ask that you limit the number of people coming to closing to only your loan officer, realtor and those signing. If at all possible, please make arrangements for childcare and only bring your children to closing as a last resort.

We ask that everyone coming into the office be fever free, without the use of fever reducing medication, for at least 24 hours. Please call us to reschedule your closing if you are feeling ill. We will make all efforts to accommodate those requests.

If you and your clients feel that it is in their best interest to push closings back, we understand and will work with you to reschedule as needed. We will waive our mail away fee if your client would prefer to do their closing remotely. We have access to a local mobile notary service who is still operating and can accommodate our closings. The cost for that service is $150. The mobile notary will print your documents for you, bring them to you for signature at a time and place that is convenient for you. The mobile notary will then return the documents to us for recordation. You may use your own notary but understand that your closing may be delayed if the documents are printed or notarized incorrectly.

If you have a cash closing there is no need to come into our office. Please allow us to conduct this electronically and with the use of a mobile notary.

In an attempt to further limit the number of people in and out of the office, we would ask that you please mail, FedEx or wire all earnest money checks to us. We will waive all FedEx and wire fees for clients and realtors if they will allow us to deliver proceeds and commission checks in a manner other than physically picking up.

When coming to the office we would ask that you please practice social distancing. We have been sanitizing our conference rooms, including pens, after each closing and are keeping hand sanitizer on the conference room table.

Please understand that we will be running with limited staff, allowing those who can and need to work remotely to do so. We would ask that you please call the office before coming over as there may not be anyone physically in the office. We will continue to conduct closings as long as the Register of Deeds and Courthouses remain open.

We are closely monitoring the situation and will make updates available on our page and website if things should change.
