Our case on behalf of Doug and Nicole Turpin against Charlotte Latin School was heard in the NC Supreme Court yesterday. The Turpins allege breach of contract, unfair and deceptive trade practices, defamation, and several other torts against a K-12 private school that is alleged to have expelled their children in retaliation for the Turpins asking questions and expressing concerns about the school's recent change in curriculum and culture and its focus on a political agenda.

North Carolina’s highest court will decide whether parents can proceed with a lawsuit against the Charlotte private school that expelled their children in 2021.

Managing Attorney Jonathan Vogel, together with lawyers from Ward and Smith, P.A., filed a brief with the NC Supreme Court yesterday seeking a reversal of a panel of the NC Court of Appeals. Parents should be permitted to assert legal claims against private schools, like Charlotte Latin School, that are alleged to have expelled young children in retaliation for the parents seeking to discuss, consistent with the board's express direction and the provisions of the enrollment agreement, the school's sudden change in curriculum and culture and its focus on a political agenda. ⚖️📓🍎

Parents of two students kicked out of Charlotte Latin School in 2021 are asking North Carolina’s highest court to permit a lawsuit against the school to move forward. Doug and Nicole Turpin argue that the school breached its contract with the family when it expelled the two Turpin children.

The NC Supreme Court will hear this parents' rights case and will have the opportunity to ensure that private schools can be held accountable for expelling students in retaliation for their parents communicating concerns with the school's curriculum and their children's well-being. With the increase of private school enrollment following the expansion of the Opportunity Scholarship Program, this is a very important case, and we are proud to represent the Turpin family.

In a case involving alleged deceptive practices and misrepresentations by student loan servicer PHEAA against a borrower, Managing Attorney Jonathan Vogel filed a petition for a writ of certiorari today requesting that the U.S. Supreme Court resolve a circuit split on the issue of whether derivative sovereign immunity (federal contractor immunity) is an affirmative defense or a jurisdictional issue.
