Even in high-profile divorces, the most thoughtful custody agreements tend to focus on the same core idea: protecting children from adult conflict.

Recent filings involving Jessica Alba and Cash Warren include provisions requiring the parents to communicate directly with each other, keep the children out of legal disputes, and attempt mediation before going back to court.

Those principles mirror the Child’s Bill of Rights framework I use in my mediation work — a set of guiding principles that centers custody decisions on what children actually experience: emotional safety, stability, and the freedom to love both parents without being caught in the middle.

Because at the end of the day, custody decisions don’t just divide time.

They shape a child’s childhood.

A first for North Carolina family law.

This week, a North Carolina District Court Judge entered a child custody order that includes a 15-point Child’s Bill of Rights — a document I authored and that is now part of a binding court order.

Why this matters:
Custody cases are often framed around what parents want or fear. This order intentionally reframes the conversation around what children experience.

The Child’s Bill of Rights centers principles like:
• Emotional safety and freedom from adult conflict
• Stability, routine, and age-appropriate communication
• Protection from being placed in the middle
• Respect for a child’s developmental and emotional needs

By embedding these principles directly into a custody order, the court created clear expectations for parental behavior — not just schedules — and a shared framework that keeps the child at the center.

My hope is that this becomes a model for future custody orders, mediated agreements, and settlement negotiations across North Carolina.

Grateful to the court for its openness to a child-centered approach, and hopeful this represents a meaningful shift in how we protect children navigating family transitions.
