In South Carolina, a Minor in Possession (MIP) charge can arise when a minor is accused of unlawfully possessing or consuming alcohol, or attempting to purchase it.

A charge like this can have consequences that extend far beyond a single incident, including:

▪️ Criminal penalties, which may include fines and, depending on the applicable offense, jail time; and

What Happens If I Am Arrested for Driving Under the Influence in South Carolina?

A DUI arrest in South Carolina can involve more than just the criminal charges. Depending on the circumstances of the incident and your prior DUI history, you could face either misdemeanor or felony charges.

If you are arrested for DUI, you will generally be dealing with two separate legal matters:
The criminal DUI case; and The South Carolina Department of Motor Vehicles (SCDMV) administrative process concerning your driver’s license.

These are separate proceedings, and the outcome of one does not necessarily determine the outcome of the other. This distinction is often confusing for someone facing a DUI for the first time.

Your criminal case will be handled in the appropriate court based on the charge and the circumstances of your case. Depending on the facts, a DUI may be prosecuted in municipal court, magistrate court, or General Sessions Court. The seriousness of the offense can depend on factors such as your prior DUI convictions, your blood alcohol concentration, and whether anyone was seriously injured or killed.

For example, a DUI resulting in serious bodily injury or death can result in felony charges in General Sessions Court, with significantly more serious potential consequences than a standard misdemeanor DUI.

Because the criminal case and the SCDMV administrative process involve different procedures, deadlines, and potential consequences, it is important to understand both from the beginning of your case.

🚨 SOUTH CAROLINA DUI LAW: IGNITION INTERLOCK 🚨

A quick summary of S.C. Code Section 56-5-2990:

• Drivers convicted of DUI in South Carolina must install an ignition interlock device to obtain restricted driving privileges.

• The device requires a breath sample before the vehicle will start.

• First offense DUI convictions generally require a 6-month interlock period.

• Higher BAC levels and repeat offenses can significantly increase the required interlock time.

• Drivers are responsible for installation costs, monthly monitoring fees, and compliance requirements.

• Missed calibrations, failed breath tests, tampering allegations, or driving a vehicle without the device can result in additional penalties or extensions.

• Interlock requirements can impact both the criminal case and driving privileges.
