Suffice to say I represent people in litigation. These are clients who have cases that may wind up in court. I understand going to court is stressful for many people but it's what I do and, to be honest, I enjoy making my case to a judge or jury. Fortunately most claims settle without the need for trial. However, we believe the only way to bring a defendant to productive negotiations is for your attorney to prepare every case as if it is going before a jury. Preparing every case for trial is one of the most effective ways to resolve your claim out of court. Ultimately, however, some cases have to be tried. My office and my staff prides itself in our litigation experience. Some lawyers simply don't like trying cases. Some of the claims I handle are scientifically or technically complex. Those involving medical malpractice, products liability or catastrophic work site accidents, by example, are often especially dependent upon the quality of expert support. Our experience in proving complex claims through forensic evidence makes a difference. I also want to make it clear that a lawsuit is not a "lottery" or "jackpot." This may turn some people off. However, the people who need my help are facing an unexpected problem. Some of my clients have lost a loved one or have been seriously hurt. Others have suffered serious financial harm because of some wrongdoing. I never forget that my income is dependent upon helping others. A "good" case as lawyers call it means something bad happened to someone who is usually a good person. I don't see this as a jackpot. Most of my clients would gladly trade their lawsuit to be put back in the position they were in before something bad happened to them. We accept cases on a contingent fee basis. In other words, we only collect attorney's fees after we recover money following a settlement or successful trial. I'm wondering what others think of this sentence. I had a case against Freedom over 10 years ago. A client of mine was exposed to one of the company's chemicals. I asked to take the testimony of Freedom's environmental officer and, while I'm not 100% sure, I believe this was the same guy. Regardless, the environmental officer I deposed could not answer basic questions about the chemical in my case. Since Freedom is a "middle-man" he got his information from the manufacturer and/or outside consultants. He was an accountant with no training in environmental issues. In short, he simply got documents from somewhere else and kept them on file, but he didn't really know what they meant. Again, he was the environmental officer for a chemical holding company sitting next to the river bank just upstream from the water intake system for several hundred thousand people. I'm not criticizing this particular sentence b/c there is sometimes more to these proceedings than meets the eye. However, as reported, it's hard not to think this man was rewarded for not knowing what he was doing. It bothers me that as an environmental officer he had no clue how harmful these chemicals may have been and essentially "got lucky" that it wasn't worse. Maybe the upcoming sentences will be heavier but this one seemed light to me.

If you live or work in Charleston below is a link to the City's FB page with an update on the street situation. I've had some questions about people having to abandon their vehicles over the weekend and it looks like there is a chance the plows may snow some others in as they clear the roads. If you have insurance many if not most policies include towing coverage for disabled vehicles. Your vehicle does not have to become disabled in a wreck for the coverage to apply. If you or someone you know has a vehicle that was towed, or winds up being towed due to the snow, then they are likely covered for that cost. Just a FYI. Stay safe:
