Today, one of our clients did something that takes real courage. 💙

John Paganini — the man at the heart of a landmark case now before the Ohio Supreme Court — traveled to Columbus today to testify before the Ohio Senate in support of S.B. 292.

This bill would raise Ohio’s caps on what patients harmed by medical malpractice can recover for pain, suffering, and permanent loss of quality of life. These caps were set years ago and have never been adjusted for inflation. For people like John, the gap between what the law allows and what true justice demands is immense.

The Ohio Supreme Court heard arguments in John’s case against the Cataract Eye Center of Cleveland this past February. We are waiting on their decision. But John isn’t simply waiting — he is fighting on every front available to him, and doing it with a grace and determination that humbles everyone around him.

We were proud to stand beside him at the Statehouse today. 🏛️

They test persistence, preparation, and a commitment to uncovering the truth.

After years of litigation, extensive discovery, and a nearly 20-hour virtual inspection of medical records, critical evidence was uncovered - hundreds of pages that had not been produced, including documentation that changed the course of the case.

The court found that Summa Health had withheld evidence and issued sanctions. Additional proceedings followed.

In the end, $221,983.98 was recovered as a direct result of that misconduct, tied to years of obstruction and failure to produce records.

Cases like this are not about moments in a courtroom.
They're built piece by piece, detail by detail, through careful, disciplined work.

“Are you with me?”

It’s a question Jeremy Burnside asked Susan many times.
Not for agreement, but for conviction.

Some people leave a lasting impact not just through what they achieve, but through how they show up - for their clients, their colleagues, and the profession itself.

But she has this.

She kept that card.

Recently, following a sanctions award related to the withholding of critical evidence in a medical case, Petersen & Petersen made a $40,000 matching contribution to the Jeremy Burnside Scholarship Fund.

That contribution was made on behalf of trial lawyers Chris Patno and Dustin Herman, who stepped forward as experts and refused payment—choosing principle over compensation.

With the support of others, that commitment became $80,000.

Now an evergreen scholarship fund in honor of Jeremy’s memory.
