Below is my post from a couple months ago regarding my Dad and I raising money in my Grandfather’s honor for the Leukemia and Lymphoma Society. I’m proud to say, that with just under three weeks left, Team Leone is the 4th highest fundraising team in Minnesota. There’s still time to help us move up the rankings, as 3rd place is still in our sights. My fundraising site is attached for anyone who would like to support us as we climb, conquer, and cure.

“For the the past four years, I have participated in an event called Big Climb MPLS to raise money for The Leukemia and Lymphoma Society in honor of my grandfather, Frederick Leone. Each February all participants are challenged with climbing the 53 flights of stairs in Capella Tower, one of the tallest buildings in the Minneapolis skyline. In 2020 we were one of the last national events that was completed live, as just a few weeks later we were facing a global pandemic that has changed our world. This year, there will be no live event. Instead, on May 15, 2021, all the LLS chapters across the country will be uniting From Coast to Coast, To Climb As One. This will be a virtual event and all participants will simulate the exercise of climbing the 53 flights of stairs.

For the the past three years I have participated in an event called Big Climb MPLS to raise money for The Leukemia and Lymphoma Society in honor of my grandfather, Frederick Leone. Each February all participants are challenged with climbing the 53 flights of stairs in Capella Tower, one of the tallest buildings in the Minneapolis skyline. In 2020 we were one of the last national events that was completed live, as just a few weeks later we were facing a global pandemic that has changed our world. This year, there will be no live event. Instead, on May 15, 2021, all the LLS chapters across the country will be uniting From Coast to Coast, To Climb As One. This will be a virtual event and all participants will simulate the exercise of climbing the 53 flights of stairs.

This year I am proud to say that I will have a partner in this fundraising event. My father, Rick Leone, has joined me, and together we created Team Leone. We welcome anyone to visit our team page. Recently Leone Legal, PA teamed up with the American Civil Liberties Union and Black Lives Matter to handle a case where our client was arrested while peacefully protesting days after the killing of George Floyd. This client drove from Nebraska to make sure her voice was heard. When I first spoke with her about this case I immediately told her how proud I was of her, and everyone else involved, for standing up for justice. In our partnership with the ACLU and BLM, we took on her case at no cost to her. I’m happy to say that after discussions with the Minneapolis City Attorney’s Office, a decision was made to dismiss this case immediately.

The crime she was charged with consisted of the following: She was walking with a group to the site of the memorial on 38th & Chicago. Police approached the group and drew their weapons of “less-lethal” force. This same night several other protesters were injured, and sent to the hospital, after being shot by the police using these weapons. She, and the others in the group, immediately obeyed the police orders. That was it. No fighting. No resisting. No arguing. Just peacefully protesting.

The crime charged was a misdemeanor. By no means was this the most serious case we have handled. Yet, I would argue, it might be the most significant and meaningful case we have handled. This case stands for so much more than this one misdemeanor. It stands for the protection of the First Amendment of the Constitution. It stands for the fight for equality for all our nation’s citizens. And, hopefully, it will stand for Change.

As you may be aware, the COVID-19 outbreak has been affecting the court system, as well as everyone's everyday life. On March 13, the Chief Justice of the Minnesota Supreme Court issued an Order canceling almost all court hearings in the state through March 27. This past Friday, this cancellation period was extended through April 22. There are a few types of hearings that will still be heard by the Courts; however, in all likelihood, they we be handled remotely, with the parties likely appearing by phone.

These cancellations affect almost all of our clients and we have already begun contacting each client affected by these delays individually to let them know that their case will be postponed. Each county is handling these cancellations differently. Last week a couple counties rescheduled our cases out into May (Hennepin - Ridgedale) and July (McLeod). While other counties simply canceled our hearings with new dates to be given in the future when there's more clarity regarding the extent of these delays (Carver, Isanti, Meeker, Nicollet and Washington). Court Administration staff in each individual county are currently going through thousands of cases, so it will take some time before we hear from them regarding all of our affected cases; especially if the case was not originally scheduled until a few weeks from now.

We deeply apologize for the delay, but can assure you that we are continuing to work on all of our cases even while the courts are virtually shut down. Updates on your cases may be slower than expected, as many prosecutors are currently working part time or taking an extended break; therefore, slowing down potential negotiations in some of our cases. Our goal remains the same: to fight to protect our client's rights and obtain the most favorable result possible on their case.

I look forward to seeing everyone back in court after we defeat this virus. In the meantime, please follow all the recommendations and guidelines we have been hearing over the last few weeks. Together we can all make a great difference.

A week from today is the Big Climb Mpls event that raises money for The Leukemia & Lymphoma Society. For the third straight year, I will be participating in honor of my grandfather. We will be taking on the Capella Tower, one of the tallest buildings in the Minneapolis skyline. Starting from the lobby on the first floor, we will head straight up to the 53rd floor. For the fourth year in a row DWI arrests in Minnesota have increased. According to this article there were 187 arrests on New Year’s Eve. That’s a lot of people who could use a good attorney. Remember, just because you were arrested does not mean you will be convicted. There are different standards of proof used for an arrest (probable cause) and a conviction (beyond a reasonable doubt). Also, it is very important to take the appropriate steps to ensure your right to challenge the driver’s license revocation (as well as vehicle forfeiture) that comes with a DWI arrest. This process is separate from the criminal case and can get complicated. You can beat the criminal charge and still end up with a DWI on your driving record if this is not challenged.

It’s a climb of the stairwell of the Capela Tower, one of the largest buildings in the skyline of Minneapolis. No elevators; just my legs and 53 flights of stairs. As a criminal defense attorney success isn’t always measured by wins and losses or how many cases are dismissed. Instead, success is achieving the most favorable result for our clients. The facts and circumstances of each case are different. More importantly, the goals of each client are different. In some cases a favorable result is getting the case dismissed. Other times, it is resolving the case in a way that results in no conviction being imposed; thus preserving the client’s clean record. And sometimes a favorable result is negotiating the best possible sentence; whether that is getting charges lowered, avoiding jail time, minimizing probation, or preserving the client’s driver’s license. With that being said, we are proud to say that 2018 has been a successful year.

Of course, success can not be achieved without clients. We want to THANK each and every client who entrusted us with the handling of their case this year. When representing a client who has been accused of a crime, we are not only just handling their case. We are in fact fighting for the client’s rights, freedom and liberty. This is not lost on us and we are humbled every day as we continue the pursuit of justice for each and every client. This year we were honored to work in courthouses from Duluth to Mankato, New Ulm to Elk River, the Twin Cities and beyond.

We wish all of you a Happy New Year and hope you have a great 2019. Have fun tonight and enjoy your family and friends. If you have to be on the roads this New Year’s Eve, please be careful and stay safe. We witnessed multiple spin outs this afternoon on I-94 between St. Cloud and Maple Grove. The snow is suppose to continue into the evening, so take your time so that you can ensure that you arrive at your destination.
