Case law update from The Juvenile Defender People v. Travis, 2026 IL App (5th) 240583. Dario Travis received a 23-year sentence for an offense that occurred when he was 20 years old, as a result of an open plea agreement. His co-defendant, who fired the shot that struck the victim in the head, was 26 at the time of offense and received an 11-year sentence as a result of a negotiated plea agreement. As the plea agreement was negotiated, the court in co-defendant's case did not have a PSI and heard no information concerning their social history, character, rehabilitative potential, or history of probation noncompliance. In a first case where the appellate court had to compare a sentence imposed following an open plea of guilty with a sentence imposed following a fully negotiated plea of guilty, the appellate court upholds Dario’s sentence despite the difference in sentence length. “Accordingly, based on the fundamental differences as to the quality and quantity of the information available to the sentencing court in open versus negotiated plea agreements as stated in detail above, this court is unable to compare this defendant’s sentencing following an open plea to [co-defendant's] sentence following a fully negotiated plea. Thus, we cannot conclude that defendant’s sentence was disproportionate to [co-defendant's] sentence.” ¶ 41.

I teach Know Your Rights trainings, and I can't teach them enough! What to do when you find yourself in the back of a police car? Nothing. Just sit QUIETLY and look out the window. If you talk, you are waiving your 5th Amendment right to remain silent and your 6th Amendment right to counsel. Just please, look out the window and remain silent. If you talk, you have waived your right and I cannot do a motion to suppress because YOU WAIVED YOUR RIGHT by babbling all the way to jail.....which is on video. YOU ARE IN A POLICE CAR BEING RECORDED! So, again, if your ever find yourself in the back of a police car. Just sit QUIETLY and look out the window! 🙂

Thoughts from a criminal defense attorney! Really quick again, when the police ask you, "Let me hear your side of the story....", the proper answer is "I would really like to tell you my side of the story. Let's arrange for a time when I can meet you with my lawyer present". :-) If you talk to the police, you are waiving your precious 5th Amendment right to remain silent and your 6th Amendment right to counsel. These are precious rights! Always best to not waive them and protect yourself!
