Summary Judgment Dismissal in Queens County
BBO&C Partner Brian Connor secured a summary judgment dismissal on behalf of the owner of a vehicle involved in a motor vehicle accident in New York State Supreme Court, Queens County. The driver’s three passengers alleged that they suffered serious personal injuries. The Court held that the plaintiffs failed to meet the threshold for serious injuries and granted defendant’s motion for summary judgment in its entirety. Hon Maurice E. Muir issued a decision in September 2025.

Summary Judgment Dismissal in Suffolk County

BBO&C Partner Joseph O’Connor secured a summary judgment dismissal on behalf of a hospital and health system in New York State Supreme Court, Suffolk County. Plaintiff alleged that defendants were negligent resulting in a trip and fall on a sidewalk resulting in personal injuries. BBO&C established through an expert surveyor that defendants did not own, occupy, control, or make special use of the walkway where plaintiff’s accident occurred. Hon. Christopher Modelewski issued a decision in August 2025 granting the summary judgment dismissing the Complaint.

Summary Judgment Dismissal in Nassau County

BBO&C Partner Tracy Abramson recently secured a summary judgment dismissal on behalf of two physicians (a hospitalist and a pulmonologist/critical care specialist) and a hospital client in New York State Supreme Court, Nassau County. Plaintiffs alleged that there was a failure to diagnose and treat serious complications, including a post-operative fistula, following surgeries at prior treatment facilities. BBO&C established through a hospitalist expert, an expert in radiology, and an expert in critical care, pulmonary medicine, emergency medicine , and internal medicine that defendants did not deviate from the standard of care or proximately cause the plaintiff’s injuries. Hon. Denise L. Scher issued a decision in October 2025 granting the summary judgment motion in its entirety.
