Even with a will or trust in place, certain assets can still end up going through probate if a few key details are missed. Here are some of the most common reasons we see 👇

🏦 Bank accounts without beneficiaries

If a bank account does not have a payable-on-death (POD) or transfer-on-death (TOD) designation, it typically becomes part of the probate estate. This can happen even when a will exists.

🏠 Real estate titled individually

When real property is owned in one person’s name and is not held in a trust or titled with survivorship rights, probate is usually required to transfer ownership after death.

📝 Outdated or unclear beneficiary designations

If a beneficiary has passed away, was never updated, or the designation is unclear, the asset may end up in probate rather than passing directly to a loved one.

📁 Trusts that were never fully funded

Creating a trust is only part of the process. Assets that were never properly transferred into the trust may still require probate, despite the trust being in place.
