DENIED A VISA? HERE’S WHAT YOU CAN DO NEXT

One denial doesn’t have to be the end of the road.

If your visa was denied, here’s what you should do next:

🔴 1. Don’t panic — but don’t ignore it
A denial letter usually includes a reason or reference to a legal section (e.g., 214(b), 221(g), 212(a)). That information matters.

✔️ Save all documents you received, and write down everything you remember from the interview or correspondence.

🔴 2. Understand why you were denied
Common reasons include: lack of strong ties to your home country, incomplete documentation, prior immigration violations, or ineligibility under U.S. law.

✔️ If you identify what went wrong, it will help you to build a stronger case.

🔴 3. Don’t just reapply without a strategy
Reapplying with the same approach — or without fixing the underlying issue — often leads to a second denial.

✔️ Before reapplying, evaluate what’s changed and whether a waiver or different visa is a better path.

🔴 4. In some cases, you may be eligible to appeal or refile
You may be able to appeal the decision or request a waiver — depending on the visa type and reason for denial.

✔️ Every case is different. An Iowa-based immigration lawyer can help you choose the right next step.

THE #1 THING I TELL EVERY CLIENT IN THEIR FIRST CRIMINAL DEFENSE CONSULTATION

When someone walks into my office after being charged with a crime — or even just contacted by law enforcement — they’re usually scared and under pressure.

Fear of what might happen.

Fear of jail, a record, the unknown.

That’s why I always start with the same message:

“You don’t have to fix this today. You just have to stop making it worse.”

✅ Here’s what I want every person in Iowa to know the moment they’re accused of a crime:

🔴 The legal system isn’t built to automatically protect your side — it’s built to move cases forward.
Once you’ve been accused or arrested, the wheels are already in motion. The police have a report. The prosecutor has a file. The court has a schedule. They don’t know your full story.

✔️ You have the right to remain silent for a reason. Use it. Call your lawyer.

🔴 “It’s just a misdemeanor”.
Many people assume that if their case isn’t serious — or if they’ve never been in trouble before — it will “go away” or “get sorted out.” That’s not how the system works.

✔️ A misdemeanor in Iowa can lead to jail time, fines, probation, license suspension, employment problems, or immigration issues.

🔴 The consultation isn’t about judgment — it’s about protection.
You might be embarrassed, angry, or afraid. You may think your case is a misunderstanding or a mess, and maybe it is. But in my office, we don’t judge people for the situation they’re in. We focus on how to move forward.

✔️I’ve worked with people from all walks of life. Everyone deserves a fair defense.

TOP 3 MISTAKES PEOPLE MAKE AFTER GETTING ARRESTED
(And What You Should Do Instead)

Being arrested is scary. Whether it's your first time or not, emotions run high and it's easy to make costly mistakes that can affect your freedom, your record, your family, your future — even if you're innocent.

At , we’ve seen it all. Here's what you need to know so you don’t sabotage your own defense:

🔴 Mistake #1: Talking to the Police Without a Lawyer
You might feel tempted to “clear things up” or “explain your side.”
Don’t.
Anything you say can and will be used against you — and even innocent people get tripped up under pressure.
✅ Instead: Politely say, “I’m invoking my right to remain silent. I want to speak to a lawyer.”

🔴 Mistake #2: Consenting to a Search
Police may ask, “Mind if we take a look in your car or house?”
If you say yes — even casually — they can legally search.
✅ Instead: Say “I do not consent to a search.” Don’t resist, but don’t agree.

🔴 Mistake #3: Posting About the Arrest Online
We get it — you’re angry, scared, and want to tell your side.
But social media can hurt your case. Prosecutors will dig for anything.
✅ Instead: Stay silent online. Call a lawyer. Let your legal team do the talking.

💼 At Scheetz Law, we defend good people facing tough situations. We focus on criminal defense and immigration law — and we know how high the stakes can be.
Whether you're dealing with a DUI, drug charge, domestic violence allegation, or immigration-related arrest, you don’t have to face it alone.

WHAT TO DO IF YOU'RE ACCUSED OF A CRIME YOU DIDN’T COMMIT
Being innocent is not enough. You need a defense.

Getting accused of a crime you didn’t commit can feel like the world has flipped upside down. It’s unfair, terrifying, and can damage your reputation even if you're never convicted. But the truth is — you can’t afford to handle it passively.

At The Law Office of Raphael M. Scheetz, we’ve helped people across Iowa clear their names and protect their futures after false or exaggerated criminal accusations.

Here's what you need to do immediately:

🔴 Do not talk to police without a lawyer — even if you're innocent
It’s natural to want to explain or prove your innocence. But talking without legal representation can backfire — your words can be misunderstood or taken out of context.

✔️ Stay calm and respectfully say, “I want to speak with an attorney before answering any questions.”

🔴 Gather names of witnesses and preserve evidence
If you know people who can vouch for where you were or what happened, write down their names and contact info. Save messages, photos, or anything that supports your version of events.

✔️ The sooner you preserve this, the stronger your defense becomes.

🔴 Stay away from the person or situation involved
Do not reach out to the alleged victim or try to “smooth things over.” This could be misinterpreted as intimidation or tampering.

✔️ Let your lawyer handle all communication. Your job is to stay clear and stay protected.

If you've been accused of a crime in Iowa, don’t wait to “see what happens.” Be proactive. Be prepared. Be defended.

TOP 3 REASONS GREEN CARD APPLICATIONS GET DENIED

The mistakes are more common — and preventable — than you think.

At The Law Office of Raphael M. Scheetz, we’ve helped many Iowa families through the green card process.

And we’ve also seen how small errors or wrong assumptions can lead to heartbreaking denials.

If you're planning to apply or waiting for a decision, this post could save you time, money, and emotional stress.

Here are the top 3 reasons green card applications get denied — and how to avoid them:

🔴 1. Incomplete or Incorrect Forms
Missed fields, inconsistent information, or wrong filing categories can trigger automatic denial. The USCIS process isn’t forgiving — even minor errors can create major setbacks.

🔴 2. Missing Evidence or Weak Supporting Documents
It's not enough to say you're eligible — you have to prove it. Lack of birth certificates, proof of legal entry, or insufficient relationship documentation (for marriage-based applications) can result in delays or denials.

🔴 3. Criminal History or Immigration Violations
Even a minor legal issue can complicate or disqualify your case. Past visa overstays, misrepresentation, or arrests — even without a conviction — can raise red flags.

Immigration law is complicated — but preventable mistakes don’t have to cost you your future. We help clients across Iowa get it right the first time.

WHAT TO DO IF YOU’RE PULLED OVER BY POLICE
Your behavior in the first 60 seconds can shape the outcome.

Getting pulled over can be stressful — even if you haven’t done anything wrong. But how you respond can make the situation better… or much worse.

The Law Office of Raphael M. Scheetz has represented countless clients who made avoidable mistakes during traffic stops. Here’s what you need to know:

🔴 Stay calm and pull over safely
Use your signal, pull over to a safe spot, and keep your hands visible on the steering wheel. Sudden movements can be misinterpreted.

🔴 Don’t argue or try to talk your way out of it
Even if you believe the stop is unfair, now is not the time to argue. Stay polite and quiet — you’ll have your chance to contest it later.

🔴 You have the right to remain silent
You are required to give your name, license, and registration. But you don’t have to answer questions like “Where are you going?” or “Have you been drinking?” If you want, you can simply say, “I choose to remain silent.”

🔴 You do NOT have to consent to a search
If an officer asks to search your car, you can say, “I do not consent to a search.” Be firm but respectful. Never physically resist.

🔴 Ask if you are free to go
If the officer is done and hasn’t placed you under arrest, ask, “Am I free to go?” If they say yes, leave calmly and silently.

A calm, respectful approach + knowing your rights = your best defense.

At The Law Office of Raphael M. Scheetz, we help good people protect their rights and their future. If you’ve been charged with something after a traffic stop, don’t guess.

A criminal charge is never just a case file, it’s a turning point in someone’s life.

When people think about criminal defense, they often picture legal arguments or courtroom drama.

But as a defense attorney I also see another side.

Behind every case is a person. And behind that person is a family, a job, a reputation, and a future that matters.

When someone is charged with a crime, it doesn’t just affect them.

It affects their spouse, their children, their parents. It affects their ability to work and provide.

It can change the way their community looks at them, sometimes even before they’ve had their day in court.

Being charged with a crime is one moment in a person’s life.

It does not erase their history, their character, or everything they’ve worked for.

The criminal justice system moves quickly, and the rules are not always easy to understand.

Prosecutors and police have resources on their side, and it’s easy for people to feel the odds are stacked against them.

Our job is to level that playing field, to make sure every right is protected, every detail is examined, and every client has a defense built around their unique situation.

At The Law Office of Raphael M. Scheetz, we work with people who find themselves in difficult situations.

No matter the circumstances, we provide the time, attention, and strategy needed to protect their future.

Because behind every case, there is always more than meets the eye.

Behind every case is a family, a future, and a chance to start over.

FIRST TIME OFFENDER? HERE’S WHAT YOU NEED TO KNOW

You’ve never been in trouble.

And now it feels like everything’s at risk — your job, your name, your future.

If that’s you, here’s what I want you to know:

✅ Being a first-time offender doesn’t mean the system will go easy on you.
You might think:

“It’s my first offense. They’ll understand.”
“I’ll get a warning.”
“They know I’m not a criminal.”

But that’s not how the legal process works.
In Iowa, even a first-time offense can lead to jail time, probation, fines, community service, license suspension, or a permanent criminal record, depending on the charge and how you handle it.

✅ What you do next matters.
Your clean record helps, but it won’t protect you from making costly mistakes now.

Common first-time errors include:

- Talking to police without a lawyer

- Posting about the case online

- Pleading guilty just to “get it over with”

- Assuming the charge isn’t serious because it’s a misdemeanor

- Missing court dates or deadlines.

✅ You may have more options than you think, but only if you act early.
In some first-time cases, you might qualify for:

- Deferred judgment

- Diversion programs

- Probation in lieu of jail.

- Charge reduction or dismissal.

But those options often disappear if you miss deadlines, skip court, or accept a deal without understanding what it really means.

✅ You’re not a bad person — you’re in a hard moment.

Maybe it was a mistake. Maybe it was a misunderstanding. Maybe you don’t even know why you were charged.

Whatever happened, this one situation doesn’t define your entire life — and it shouldn’t define your future.

The justice system may see a case number. But we see a person who deserves a second chance, a fair defense, and a path forward.

WHAT HAPPENS IF YOU MISS YOUR COURT DATE IN IOWA?

It’s not just a missed appointment — it’s a serious legal event.

Life gets busy. You’re juggling work, kids, paperwork, transportation...

Maybe you never saw the notice. Maybe you thought your lawyer would handle it. Maybe you just froze.

But in Iowa, missing your court date — even once — can trigger consequences that make your situation harder to fix.

Here’s what you need to know if you’ve missed, or are in danger of missing, a scheduled court appearance:

⛔️ A bench warrant may be issued for your arrest.

If you fail to appear, the judge can issue a warrant right away. That means you could be arrested at home, at work, or during a traffic stop — and taken into custody.

🔒 Your bond could be revoked or increased.

If you were released on bail or bond, missing court may be seen as a sign you’re not taking the process seriously. The court could raise your bond amount or refuse to release you again.

🚫 You may face additional criminal charges.

In some cases, failing to appear is a separate criminal offense, especially if the original charge is more serious. That means even more penalties.

❌ You’ll lose the opportunity to resolve your case favorably.

Missing court often removes the possibility of a negotiated plea, deferred judgment, or alternative sentencing. Judges are less likely to show leniency when you’ve failed to show up.

But here’s the good news: you can still act before things get worse.

If you missed your date, don’t wait for the knock on the door.

Take control of your case:

Call the clerk’s office to check your status.

Contact an attorney immediately to see what can be done to recall the warrant.

Show the court that you’re serious about fixing the situation.

At this point, your next step is more important than your last mistake.

The worst thing you can do is ignore it.

YOU DON’T NEED A LAWYER WHO TELLS YOU WHAT YOU WANT TO HEAR — YOU NEED ONE WHO TELLS YOU THE TRUTH

If you’ve found your way to my office, there’s a good chance life has handed you something heavy.

Maybe you’re dealing with something you never expected.

Maybe you’re trying to make the right decisions under a lot of pressure.

First, I want to say this: I see you. And I don’t take your trust lightly.

When people come to me, they’re often overwhelmed, unsure who to believe, and hoping someone will just tell them, "Everything will be okay."

But here’s the truth — and this is important: my job isn’t to tell you what you want to hear. It’s to tell you what you need to know.

I’m not in the business of making empty promises or selling false hope.

That might feel good in the short term, but it can cost you everything in the long run.

I’d rather give you the real picture — even if it’s hard — and help you build a strategy that protects you, step by step.

Sometimes that means hearing that your situation is serious. Sometimes it means facing hard truths.

But it also means you’re no longer guessing. You’re no longer in the dark. You have a path.

What I can promise is this:

I will always be honest with you.

I will explain everything in plain language.

I will take your case seriously, no matter who you are or where you come from.

That’s how I work.

We help good people in difficult situations.
