Close to a year ago law enforcement stormed a home belonging to a client of ours. There was an emergent situation that was quelled within minutes. Officers searched the home and seized over $250,000.00 worth of weapons (over 100 devices). Our Senior Associate Attorney Ethan Campbell investigated the case thoroughly, researched the issues and later filed a motion to exclude any evidence gathered during the search. This week a court granted the motion to suppress thereby gutting the case and forcing the State Attorney to drop some very serious weapons charges that could have landed our client in prison for up to 30-years. This week Mr. McDermott wrapped up a federal conspiracy case involving the sale of common marmosets without proper licensing while serving probation. Lacy Act Violation. Authorities tried to allege that our client “The Monkey Whisperer” had mistreated the animals he sold and the animals he cared for at his exotic animal ranch (The Monkey Ranch) in Parrish, FL. Mr McDermot was able to prevail on the issue of any sort of mistreatment of the animals and the judge ruled that every single allegation of mistreatment or neglect be stricken from the pre-sentence investigation report. Although the client will be doing some prison time, likely a camp for 9-months, he felt vindicated when the judge issued that decree removing any consideration that he mistreated animals. personalinjuryattorney
