What Is Probate?
Probate is the legal process that may occur after someone dies to deal with property and other assets that were owned in that person's individual name.
Depending on the circumstances, probate may involve:
• Proving and recording the deceased person's Will
• Appointing an Executor or Administrator
• Identifying and collecting estate assets
• Paying valid debts, expenses, and claims
• Handling real estate and other property
• Distributing the remaining assets to the proper beneficiaries or heirs
Does every estate have to go through probate?
No. Many assets can pass outside of probate—for example, property held in a properly funded trust, jointly owned property with survivorship rights, and accounts with valid beneficiary designations.
