Our team of three is made up of Colleen, our founding attorney; Emily, our associate attorney; and Dianna, our office administrator. from UIC Law (formerly The John Marshall Law School) in Chicago, Illinois in 2006 and has more than a decade of legal experience representing individuals and businesses. As a mother and a wife, a sister, and a former caregiver to her mother, Colleen particularly enjoy working with families with young children and those caring for aging parents. She knows how difficult it can be to balance the many responsibilities and plan for the future. Estate planning and probate and trust administration allow me to draw upon Colleen's prior legal experience and long-time commitment to helping and educating others. Emily Bennett is an associate attorney at the firm and a graduate from University of Denver Sturm College of Law. Life Changed? Your Will Might Need an Update

You and your spouse took the important step of creating a comprehensive estate plan. At the time, everything was exactly as it should be. But years later, life looks a little different—and you may be wondering if you need to start all over.
In many cases, you don’t.

A codicil is a legal document that allows you to modify, update, or clarify specific parts of your existing will without rewriting the entire document. Since wills should be reviewed every 3 to 5 years anyway, adding a codicil is often the most efficient solution for minor changes.

Situations where a codicil may be appropriate include:

• Adding or removing an executor
• The birth of a child or addition of stepchildren
• Marriage or divorce
• A name change
• The death of a beneficiary
• Adding provisions for a new trust

A will is a “living” document—it should reflect your current life and future goals. The best first step is to schedule a review with an experienced estate planning attorney. If the changes are substantial, a new will may be recommended. If not, a codicil may be all you need.

Intestate vs. Probate: Is There a Difference?

A Last Will and Testament allows you to decide how your property and assets will be distributed after your death. Without one, the court—not you—makes those decisions.

When someone passes away intestate, it means they did not have a valid will in place. In that case, state law determines who inherits their assets, which may not reflect their wishes.

Probate, on the other hand, is the court-supervised legal process used to settle an estate. Whether or not a person has a will, their estate must go through probate. However, when there is no will, the process is often longer, more expensive, and more stressful for loved ones.

The bottom line:

✔️ A will doesn’t eliminate probate
✔️ But it makes the process smoother and ensures your wishes are honored
