While a prenup and an estate plan often work together, they serve very different purposes. A prenup addresses what happens if a marriage ends, while an estate plan helps address what happens if you pass away or become unable to make decisions for yourself.

One does not replace the other, which is why both are often important parts of a smart plan.

Even pre-marital businesses can be affected in divorce. A lot of business owners assume their company is automatically protected simply because they built it before getting married, but that is not always the case.

In North Carolina, growth in the value of a business during the marriage may still become part of the divorce. Without protection in place, cases involving businesses can quickly become expensive and complicated, especially when valuations, partners, or buyouts are involved.

The sixth step in the divorce process is deciding whether to negotiate, mediate, or file.

Sometimes cases can be resolved through negotiation and compromise. Other times, mediation helps move things forward with the assistance of a neutral third party working between both sides.

If those options are not successful, the next step may be filing and asking the court to step in and make decisions about your case. Because court is often the most expensive and time-consuming route, we believe it should usually be the last resort, not the first step.

One common mistake we see is parents waiting until every decision has already been made before having that conversation. Many worry about saying the wrong thing, saying too much, or not knowing the “right” timing.

Having a thoughtful, age-appropriate plan in place can make these conversations feel less overwhelming for everyone involved.

One of the biggest questions business owners ask during the prenup process is how to determine the value of the business. The answer is: there are multiple ways to do it.

Some couples agree on a specific valuation method ahead of time, while others choose to obtain a formal valuation or agree on a set number. The important part is creating a clear starting point and framework from the beginning.

The fifth step in the divorce process is drafting a settlement proposal.

This is where we take the information and documents gathered so far and start putting your goals and priorities on paper. It does not mean everything will immediately be agreed to, there is often negotiation and back and forth involved.

But having a clear proposal is an important step forward, and in many cases, this process can begin before separation even happens.
