We’re excited to share a valuable resource to help make estate-related real estate transactions more seamless: the Estate Property Flowchart, a tool jointly approved by the North Carolina Bar Association’s Real Property Section and the NC Association of REALTORS®.

This flowchart is designed to guide you through common questions that often come up during estate property closings, including:
• Was the property jointly owned?
• Is the estate currently open or closed?
• Who should be listed as the seller in agency agreements, disclosures, and contracts?

It also highlights key cautions to keep in mind—such as avoiding the inclusion of a deceased individual on legal documents and ensuring the appropriate involvement of heirs, spouses, and estate representatives.

We encourage you to take a few minutes to review the flowchart and keep it handy for any future transactions involving estate properties.

If you ever have questions or would like to walk through a specific scenario, don’t hesitate to reach out. Our office is always here to help.

📢 Just Married & Selling Your Home? Here’s What You Need to Know! 🏡💍

Life changes—so do property rights! If you bought a home before marriage in North Carolina, selling it may not be as simple as you think. Even if your name is the only one on the deed, your spouse might still need to sign at closing.

⚖️ Key Things to Consider:
✅ Spousal Joinder – Your spouse may have a marital interest, even if they aren’t on the title.
✅ Divorce & Remarriage – Make sure past spouses have transferred ownership properly to avoid title issues.
✅ Refusal to Sign? – If your spouse won’t sign at closing, it could delay or stop the sale!

🔍 How to Prepare:
📜 Review your title history
⚖️ Confirm spousal rights with a real estate attorney
📝 Resolve any ownership issues in advance
🏡 Communicate with your closing attorney early

Avoid surprises at closing—plan ahead! If you’re selling a home after marriage, divorce, or remarriage, we can help ensure a smooth process.
