After a car wreck in Georgia, medical bills can start arriving before anyone sorts out who was at fault. Here is a benefit a lot of drivers do not realize they have:

- Many auto policies include optional Medical Payments coverage, often called MedPay.
- MedPay can help pay medical bills from a crash no matter who was at fault.
- It often covers you and your passengers, up to the limit you purchased.
- You already paid the premium for it - so it is a benefit you can put to use.

It is worth checking your own policy's declarations page to see if you have it. Questions about a car wreck in Bartow County or North Georgia? The Delashmit Firm is local and glad to help you understand how the process works.

Got hurt on the job in Georgia? One of the most important early steps is also one of the easiest to overlook: telling your employer. Here is the plain version:

- Report the injury to your employer as soon as you reasonably can.
- Georgia workers' comp generally gives you 30 days to give that notice (O.C.G.A. 34-9-80).
- Notice can be verbal, but putting it in writing - and keeping a copy - helps avoid disputes later.
- Waiting too long to report can put your benefits at risk, even on a legitimate injury.

After a wreck, a lot of people assume that if they were even a little bit at fault, they have no claim at all. In Georgia, that is not necessarily true. Here is the plain version:

- Georgia follows what is called 'modified comparative negligence' (O.C.G.A. 51-12-33).
- Sharing some of the blame does not automatically end your claim - your recovery is generally reduced by your percentage of fault.
- You are typically barred from recovering only if you are found 50 percent or more at fault.
- Fault is often disputed, so it is worth asking questions before you assume the answer.

What happens if the driver who hit you has no insurance - or not enough to cover your injuries? In Georgia, there is a coverage that can help: Uninsured/Underinsured Motorist (UM/UIM). Here is the plain version:

- UM/UIM is optional coverage on YOUR own auto policy.
- It can step in when the at-fault driver has no insurance, or not enough to cover your damages.
- In Georgia, insurers must offer it, but you can accept or reject it in writing - so many people are not sure whether they have it.
- It is worth checking your own declarations page to see if you carry it, and how much.

Here's something a lot of folks in North Georgia don't realize until it's almost too late: injury claims come with a deadline.

In Georgia, most personal-injury lawsuits must generally be filed within two years from the date of the injury (O.C.G.A. 9-3-33). Miss that window and a court will usually refuse to hear the case - no matter how strong it is.

Two years can feel like plenty of time when you're focused on healing and getting back to work. But it goes faster than you'd think, and some situations have different or shorter deadlines - for example, claims involving a city, county, or other government entity, or claims involving a minor. Those follow their own special rules.

The takeaway isn't to panic - it's simply to ask questions early so a deadline never decides your case for you. The Delashmit Firm is right here in Cartersville and happy to help you understand the timeline that applies to your situation.

General information about Georgia law, not legal advice. Deadlines vary by case.

A quick, honest myth-buster for anyone dealing with an injury claim in Georgia.

After a wreck, the insurance adjuster who calls is usually friendly, fast, and reassuring. That's their job. But it's worth remembering a simple fact: the adjuster works for the insurance company, not for you. Their role includes keeping claim costs down.

That doesn't make adjusters villains - many are decent people doing their jobs. It just means the early phone call, the recorded statement, and the quick offer are coming from the other side of the table. It's okay to slow down, get medical care, and understand your rights before you agree to anything or sign a release.

At The Delashmit Firm in Cartersville, we believe informed people make better decisions. If you have questions about how the process works in Georgia, we're glad to talk it through - no pressure.

"Do I HAVE to see the company doctor after I get hurt at work?" It's one of the most common questions injured Georgia workers ask. Here's the plain version 👇

✅ In Georgia, your employer is generally supposed to post a Panel of Physicians — a list of approved doctors for work injuries.
✅ You usually get to pick which doctor on that panel treats you.
✅ Georgia law generally lets you make one change to another doctor on the same panel without asking your employer's permission.
✅ If your employer never posted a valid panel, you may have more options than you think.

Knowing how the panel works can make a real difference in your care. Questions about a work injury in Bartow County? The Delashmit Firm is local and happy to help you understand the process.

Ever wondered if you could get car insurance for free? 🤔

This story is about as close as it gets!

One of our clients was seriously injured in a crash that occurred while she was on the job and she now requires multiple surgeries due to her injuries.

The client’s employer’s insurance policy showed $0.00 in underinsured motorist coverage (the kind of coverage that would compensate my client for her injuries) but $1,000,000 in liability (the kind of coverage that pays someone if she hits them). At The Delashmit Firm, we know that the insurance company must maintain a signed document where the policyholde rejects underinsured motorist coverage under O.C.G.A. § 33-7-11.

Here’s the kicker: if they dont have this document, then there is by operation of law underinsured motorist coverage in the same amount as the liability coverage.

In this case, they couldn’t produce it the form.

Result: $1,000,000 in UIM coverage to protect my client that NO ONE WAS PAYING FOR!

It is vitally important to investigate coverage after a car accident. Call The Delashmit Firm at 770-341-0559 so we can help you or your loved ones investigate the coverage available to help in the recovery after an accident.
