It was a good day for our clients in court today! The plaintiff presented her case-in-chief, and we prevailed on a motion for judgment based on their lack of evidence. We therefore prevailed in the lawsuit without putting a single witness on, thereby saving our clients substantial fees to litigate their defense.

The atmospheric rivers continue to hit our area, and this morning our power went out at 8:00am. We still have no update as to when power will be restored, and as of now we cannot access our server. Thank you for your understanding.

Ana is currently preparing tax estimates for 2018 taxes, and is quickly realizing that the industry assertions that tax withholding tables are off in light of the new tax legislation is holding true. In every instance that she has looked at, everyone is under-withheld. Even people that received raises in 2018 are having substantially less withheld than for 2017. It appears that many people used to getting refunds will either be getting nothing (if they are lucky) or having to pay. If you want to discuss your 2018 tax liability with Ana and see if there is anything you can do to alleviate this, please contact her.

The US Supreme Court has affirmed that a private landowner is required to provide public access to his private beach while he pursues a coastal development permit. It did this by denying the petition filed by Vinod Khosla to overturn a California Court of Appeal decision requiring him to provide public access to his beach. Tax time is done, but it doesn't mean that you can sit back and ignore your taxes until next year. If you are getting a big refund back, you may want to adjust your withholding so that you aren't giving the government a nice, big, tax-free loan. Or, perhaps you need to adjust your estimated payments for the next year. Ana would be happy to sit down with you and make sure your tax planning is appropriate.

Unclean hands is an important affirmative defense to equity causes of action. If you lie on a building permit application in order to expand your encroachment on your neighbor's property (who happens to be our client), don't expect the court to support your claim of an easement by estoppel. Yet another good outcome for our client.
