Could your child's inheritance be at risk?

Even though California generally treats inheritances as separate property, inherited wealth can lose its protection through commingling, creditor claims, divorce, or lawsuits.

A continuing trust may provide an additional layer of protection that many families overlook.

Thinking about using AI to update your trust or estate plan?

With the rise of AI tools and online templates, it’s becoming increasingly common for individuals to consider drafting their own estate planning documents, especially when trying to save on costs or when time feels limited before a major life event, like an upcoming international trip.

We understand the motivation. However, this is one area where shortcuts can create significant, and sometimes irreversible, problems such as:

• Unintended disinheritance
• Family disputes and litigation
• Invalid or unenforceable amendments
• Costly court proceedings
• Exposure of sensitive private financial information

Click the link below to learn more about the pitfalls of drafting your own estate planning documents.

In our previous posts, we encouraged you to locate your estate planning documents as part of your spring cleaning and confirm that the agents listed are still the right people to have in place.

Now, let’s take it a step further, have there been any major life changes since your plan was created?

Start by asking yourself:

-Have there been any births, deaths, marriages, or divorces in your family?
-Any changes in health?
-Have you opened or closed any bank or financial accounts? Including retirement accounts or life insurance policies?
-Bought or sold any real estate or refinanced a mortgage?
-Been involved in a lawsuit or inherited assets?
-Business ownership changes?

These kinds of changes can affect how your estate plan operates. If your documents no longer reflect your current circumstances, they may not carry out your wishes as intended.

An effective estate plan should grow and adapt alongside your life. If things look different today than when you first signed your documents, it’s likely time for a review.

If you, a friend, or a loved one needs help establishing or updating an estate plan, we’re here to help. In our last post, we talked about spring cleaning and encouraged you to locate your estate planning documents. Did you find your estate planning documents during your spring cleaning?

If you did, now comes the important next step: making sure everything is still up to date.

Start with your “who”:
-Are the people you’ve named as your agents (trustees, executors, powers of attorney, healthcare agents, guardians for minor children) still the right fit?
- Are they still part of your life… and able to serve?
-Have your children grown into adulthood and now better suited for these roles?

Next, think about timing:
-How many years ago did you create your trust?

Estate planning laws change frequently, and we generally recommend reviewing your plan every 3–5 years.

If anything has changed, your plan may need updates to ensure it works as intended. A solid estate plan isn’t “set it and forget it” and should evolve with your life. If it’s been a while, now is a great time for a review. If you have not established an estate plan yet, now is the perfect time to start before summer travel and vacations begin.
