CAN SOMEONE ELSE ACCEPT PAPERS FOR YOU?

Sometimes.

Many people assume legal documents must always be handed directly to the person named in the lawsuit. While that's often the goal, there are situations where service may be completed through another person.

Whether that is allowed depends on:
⚖️ The type of case
⚖️ The circumstances
⚖️ Court rules and orders

For example, in some situations a court may authorize service on another person at a residence or business through a Rule 106 order.

The important thing to remember is that service requirements vary, and what works in one case may not be allowed in another.

That's why process servers follow court rules and specific instructions for each serve.

PROCESS SERVING: TV VS. REAL LIFE

People often imagine process serving involves dramatic chases, disguises, and action-movie level excitement.

The reality?

Most serves go something like this:

"Hi, are you John Smith?"

"Yes."

"Okay, these are for you."

And that's it.

While there are certainly challenging serves from time to time, most process servers spend far more time driving, researching addresses, completing affidavits, and filing paperwork than chasing people down.

Hollywood makes it look a lot more exciting than it usually is.

WHAT IS A RULE 106?

Sometimes, a person cannot be located or repeatedly avoids service despite multiple attempts.

In Texas, Rule 106 allows a court to authorize alternative methods of service when traditional service has been unsuccessful.

Depending on the circumstances and the court's approval, this may include:
Posting documents
Leaving documents with another person at the location
Other court-approved methods- via Facebook or Email

A Rule 106 order is not automatic. The requesting party must typically show the court that reasonable efforts have been made to serve the individual through traditional means first.

If you've heard the term "Rule 106" and weren't sure what it meant, it's simply a legal process that helps move a case forward when someone cannot be personally served.

CAN YOU BE SERVED AT WORK?

Yes, in many situations, a person can be served at their place of employment.

A process server's goal is to locate and deliver legal documents to the correct individual. If someone is difficult to reach at home, a workplace may be a lawful location for service.

That doesn't mean a process server wants to create a scene or cause embarrassment. Professional process servers typically try to handle service as discreetly as possible while following applicable laws and court rules.

Every case is different, but being at work does not automatically prevent someone from being served.

DO PROCESS SERVERS HAVE TO IDENTIFY THEMSELVES?

Short answer: Not always.

Many people believe a process server must immediately announce who they are and why they're there. In reality, the rules can be more nuanced.

A process server's job is to deliver legal documents to the correct person. Depending on the circumstances, they may ask questions to confirm someone's identity before handing over documents.

Why?

Because serving the wrong person can create problems for everyone involved.

Process servers cannot impersonate law enforcement or misrepresent themselves in ways that violate the law, but they also aren't always required to begin a conversation by announcing, "I'm a process server."

Every situation is different, and the goal is always the same: ensuring legal documents are delivered properly and in accordance with the law.

WHAT HAPPENS IF SOMEONE REFUSES TO BE SERVED?

One of the most common things we hear is:

"If I don't take the papers, they can't serve me."

Not necessarily.

In many cases, if a process server properly identifies the person and informs them of the nature of the documents, service may still be considered valid even if the individual refuses to physically take the paperwork.

Every situation is different, and service requirements vary depending on the type of case and the laws that apply. However, avoiding the door, refusing to take the documents, or pretending not to be home does not automatically make a lawsuit disappear.

If you're expecting legal documents, it's usually best to address the situation directly rather than avoid it.
