or any disease related to and or similar to this.
WHAT HAPPENS WHEN I FILE?
The Law Firm you hire is going to file an Administrative Claim with the Dept of Navy JAG. That filing will result in the department processing your claim and ultimately presenting you with an offer.
Read This Carefully:
The offer that the Department of Defense will present to you is NOT binding. You don't have to take it if you do not want it or it feels inadequate. It's fully optional at any point for you to decide that you don't want to really do this and back out.
Secondly, many Veterans are afraid that they will lose their VA Disability or Benefits if they file a Camp Lejeune Claim here. Just filing a claim of any kind will not result in your loss of any disability rating, benefits or a health care whatsoever. What you do have to consider is, if you have already filed for compensation directly related to Camp Lejeune Toxic Water Injuries and have already been granted a benefit SPECIFICALLY FOR THAT CLAIM.
Your BENEFITS will only be affected by what's called an "OFFSET" if you are already being paid or compensated for ONLY a CLAIM for CAMP LEJEUNE TOXIC WATER.
If you have a claim for Agent Orange, or a Battle Injury, or some other incident entirely, that benefit and claim will remain INTACT and will not be affected at all. The offset will only affect anyone that is already getting paid for Camp Lejeune and ONLY for CAMP LEJEUNE TOXIC WATER.
This is to prevent DOUBLE DIPPING into benefits that the Department of Defense has already agreed to pay you for toxic water exposure. If you are being compensated for a combat wound, or something else NOT RELATED, you risk nothing by applying for this compensation.
Also, the ONLY time an offset will actually take effect is if you actually agree to take the lawsuit money. Nothing happens to your CAMP LEJEUNE WATER Disability claims prior to that acceptance. You will be presented with a choice. If you choose to not take a lump sum of money, your existing Camp Lejeune Benefits will not be affected and you can carry on like it never happened.
