In California, a parent's ability to move away with a child often depends on the custody arrangement in place. Whether a parent has sole or joint physical custody can significantly impact the legal process, but the court's primary focus will always be what is in the child's best interests.

In this video, California family law specialist Marshall Waller explains the legal complexities involved in move-away and relocation requests when children are involved.

He breaks down how California courts evaluate relocation cases, including the key factors that can influence whether a parent is allowed to move with a child.

Topics covered include:
• Primary Considerations: How custody orders and the child’s best interests determine relocation outcomes
• Custody Types: Differences between sole or primary physical custody versus joint physical custody in move-away cases
• Court Evaluation Factors: Stability, schooling, extended family support, and maintaining a relationship with the non-moving parent
• Parenting Plans: Why detailed long-distance plans for travel, holidays, communication, and summer schedules matter
• Procedural Requirements: Notice requirements and what to expect if the move is contested
• Case Complexity: Why relocation cases are often some of the most emotional and complex matters in family law

Move-away cases require careful planning and a strong understanding of how courts approach the child’s best interests in these high-stakes decisions.

In many California counties, parents are required to attend court-provided mediation or counseling sessions before a custody hearing. The goal is to help parents work together to create a parenting plan that serves their child's best interests. If an agreement is reached, it can often be submitted to the court and become a formal custody order.

When deciding custody, a judge's primary focus is the child's health, safety, and well-being. The court will consider each parent's relationship with the child, the stability they provide, and their willingness to support a meaningful relationship between the child and the other parent.

Generally speaking, unless there are unusual circumstances, most families will share joint legal custody. Even if parenting time is not split 50/50, parents can still have joint legal custody and equal input on major decisions affecting their children.
