WE HAVE MOVED! 1221 S. Main St., Graham, NC 27253. Now in the building that has 83 degrees PERMANENTLY on the sign, meaning we are still hot??

Was honored as a "Super Lawyer" in Estate Planning & Probate law. Very appreciative of my peers who voted for me!

Apparently you CAN fool some of the people some of the time! Thanks to my peers who nominated me.

If you are concerned about whether your children's spouses are overbearing or the marriage is in trouble, you can leave their inheritance IN TRUST for your children. This allows your children the benefit of the assets, without mixing the assets into a troubled marriage.

Do not put too much identifying information on your public documents. I don't even suggest an address, though that may be required in some situations. I have several clients who still have their social security number on their power of attorney, and dates of birth of their children on their Wills - just asking for trouble, that.

North Carolina: If your father was NOT married to your mother when you were born, he MUST have a Will, or you will not inherit from him. It does NOT matter if you are on the birth certificate. PLEASE have this discussion (or do this Will!) if you fall in this group.

Trust your attorney, or fire your attorney. Asking questions similar to, "why is this definition necessary?" shows a lack of trust. I am not creating an original paper for English class; I am drafting a legal document based on decades of study. You have to trust me that I know what to do; I have to trust you that what you are telling me is accurate.

Have had issues again this week with people naming under-age children as their beneficiary. If your child is below age 18, they should NOT be named as beneficiary of your IRA, life insurance, or other account that calls for designated beneficiaries. You should PROBABLY have a trust under your Will to take care of the children. Also . . . even if they are 18 . . . 18 may not be the best year to get a windfall, anyway!
