There are certain key decisions that must be made anytime a trust is being planned. A trust can either be created for multiple beneficiaries out of one pool of assets (called a “pot trust”), or separate sub trust for each beneficiary, with their own separate pool of assets, can be created. When creating the latter form, you’ll want the net value to be at least $50,000 to $100,000; that way, each sub trust has enough money for the beneficiary to meet their needs. All trusts in Texas must also terminate at some point, so a final beneficiary or class of beneficiaries must be designated.

You should not leave substantial property to a minor outright. Doing so can lead to a long, expensive guardianship procedure. Instead, the property should be placed in trust until the minors are at least 18, though an older age (such as 25) is often picked. During that time, the trustee can be given the authority to use trust funds to pay for the health, education, and support of the minor. A trust can be set up during your lifetime, or one can be provided for in a will in the event you die while you still have one or more minor children.

When making a bequest to charities through a will or trust, always verify the correct title of each charitable beneficiary. Also be sure to differentiate between local and national organizations. Most vital is to confirm that the charity is an exempt organization under 501(c) of the Internal Revenue Code. IRS publication 78 contains a listing of charitable institutions that have been granted exempt status by the IRS, but that list is not all-inclusive. Many charitable organizations that qualify (namely churches) do not bother to obtain their specific exemption ruling.

Adults with special needs who receive government benefits should be careful about receiving an inheritance directly, as it could affect their eligibility for those benefits. In many cases, the better option is for loved ones to leave assets to a Special Needs Trust instead. The trust can hold and manage the inheritance for the beneficiary's benefit while helping preserve eligibility for government assistance programs. A third-party trustee must manage the trust, as the beneficiary generally cannot serve as their own trustee.

If the special needs individual ends up receiving an inheritance directly, under the right circumstances that individual may still be able to place that inheritance into trust themselves, but will still need to appoint a third-party trustee.
