The district's investigation found no substantiated evidence. Our clients are not giving up. John Elmore told 7 News they stand by everything in the notice of claim, and they want these matters heard and decided in a court of law.

After the Buffalo School Board announced its outside investigation found the claims unsubstantiated, Kristen Elmore-Garcia told News 4 that our clients still intend to move forward. Her reason: so their truth is heard, and so this does not happen to anyone else who works for or comes into contact with the district. It has been stressful and painful, and they intend to see it through.

The Buffalo School Board's outside investigation found the claims against a board member unsubstantiated. Asked whether that settles the matter, John Elmore explained what actually resolves a case: a legal process where both sides exchange evidence and give testimony under oath, open to challenge and weighed by a neutral judge or jury. A report, he noted, does not bind a court and does not bind a jury.
