People v. Carswell, 2026 IL App (1st) 231884 (February 4, 2026) 3d Div./Cook Co. (MARTIN) Affirmed.
Defendant was convicted of resisting arrest and appealed, arguing that the evidence was insufficient because the State failed to prove him guilty of an underlying offense beyond a reasonable doubt and that the trial court erred by admitting out-of-court statements. The appellate court affirmed, explaining that subsection (d) of the resisting statute, which states that a person is not subject to arrest for resisting arrest unless there is an underlying offense for which the person was initially subject to arrest, was not an element of the offense that the State was required to prove and that construing it as an element of the offense or as an exception or affirmative defense would amount to the court’s adding a provision or limitation where “the legislature did not.” (LAMPKIN and ROCHFORD, concurring)

Summer Internship Opportunity

The Law Office of Bradley L. Schencker is seeking a motivated college student for an in-person summer internship. Our practice focuses on Family Law and Estate Planning.

The successful candidate will assist with sensitive client matters, demonstrate exceptional attention to detail, and support the development of the firm’s digital form library. Strong proficiency in Microsoft Word and Adobe applications is required to successfully meet the objectives of the internship.

This internship provides a $3,500 stipend upon successful completion of 200 hours over the summer and fulfillment of all assigned projects. College credit may be available through the student’s academic institution; however, the firm cannot guarantee credit eligibility.

This position is in person only and is not considered employment. Due to the confidential and sensitive nature of the work, applicants must be 18 years of age or older.
