We are pleased and proud to announce that our colleague and friend Attorney Katherine Gatti Rooks has been appointed to serve as an Administrative Law Judge by the Workers’ Compensation Board for the State of Maine. Judge Gatti Rooks will be presiding in formal hearings from the Workers’ Compensation Board’s Lewiston Regional Office once her transition from our offices has been completed. The State of Maine is fortunate to have the skills and talents Kate will bring to the bench.

Maine workers injured on the job prior to 1992 may remember receiving annual cost of living adjustments (COLAs) to their weekly benefits. Thanks to LD 756, COLAs have returned for Maine workers injured on or after January 1, 2020 who are receiving total weekly benefits under section 212. COLA benefits will be effective after 260 weeks of total benefits have been paid.

A common defense raised by employers in Maine workers’ compensation cases is that the worker did not give notice of the injury within 30 days. The 30-day notice requirement applied to injuries that occurred between January 1, 2013 and prior to January 1, 2020. LD 756 has extended the time period for a worker to give notice of the injury to its employer to 60 days. If you are injured on the job, act as soon as possible to report the injury properly – failure to do so could result in no benefits owed.

The most tragic workers’ compensation cases result in death from an injury on the job. Prior to LD 756, if the deceased worker did not have a spouse or dependents, then no death benefits were owed by the Employer/Insurer. Now, if a worker dies as a result of a work injury on or after January 1, 2020 and he/she had no dependents, then death benefits under the Act must be paid to the workers’ parents (up to 500 weeks).
