If you received your green card through marriage, you are first issued a conditional green card valid for two years.

Before that two-year card expires, you must file Form I-751 to remove the conditions on your permanent residence.

If you are still married, you generally file jointly with your spouse and must show that the marriage is bona fide and ongoing, meaning it was entered into in good faith and continues to be real and genuine. This usually includes documents showing shared finances, a shared home, and a life together.

However, divorce or separation does not automatically end your immigration options. USCIS allows certain I-751 waivers, including:
Divorce or annulment after a good-faith marriage
Abuse or extreme cruelty by a U.S. citizen or permanent resident spouse
Extreme hardship if you are removed from the United States

Each waiver has specific legal requirements and evidence standards.

Because an I-751 filing directly affects your permanent resident status, it is important to file the correct type of petition with strong supporting documentation.
