The U.S. Supreme Court dismissed Hamm v. Smith, leaving intact longstanding protections for individuals with intellectual disabilities under Atkins v. Virginia.

At issue was whether courts can rely heavily on IQ scores alone when determining intellectual disability in death penalty cases. Disability advocates warned that narrowing the definition could have had consequences far beyond criminal law (we know this can potentially impact access to disability services, supports, and legal protections nationwide).

The Court ultimately declined to decide the issue, meaning the current clinical standard remains: intellectual disability must be evaluated holistically, considering intellectual functioning, adaptive functioning, and onset before adulthood, not just a number on an IQ test 😪

This matters because people are more than a score ⚖️🖤
