Honored to share another reversal and reinstatement won for our good friends at Gruenberg Kelly Della! This one required a dynamic presentation in a complex Labor Law appeal, whichsuccessfully revived previously dismissed claims on behalf of a seriously injured construction worker. As "ramp" cases go, this one is definitelybookmark-worthy.

Sound The Victory Horn!

Here’s another reversal and reinstatement won for our friends at Dell & Dean! This one highlights the importance of a full-throated, attacking appellate presentation as it was won on the twin arguments that the motion court had awarded summary judgment based upon a defense that was not properly before the court and, furthermore, that the defendant had substantively failed to meet its prima facie burden in this “missing handrail” case.

In March Madness parlance, this is the appellate equivalent of a full-court press!

Delighted to announce this most recent victory for our friends at Morgan & Morgan!

This one required an in-depth parsing of the various obligations imposed by the Vehicle & Traffic Law, including a duty to proceed at a rate of speed below the speed limit as the defendant's heavy construction vehicle traversed the roadway curve in question.

Delighted to win another reversal and reinstatement for our friends at Dell & Dean, who continue to fight the good fight in these school bullying cases!

In this one, the AD permitted the case to proceed and deemed a late notice of claim to have been timely served nunc pro tunc.

This is a great case to bookmark because it shows that actual timely notice and an absence of prejudice will carry the day — even in the absence of a reasonable excuse for the late service.

Delighted to announce yet another reversal and reinstatement for our friends at Dell & Dean!

This one revives a Labor Law claim that was DOA when we got to work on the appeal, and provides another great example of how the path to victory often runs through a challenge to a moving party's prima facie showing.

The best defense is often a good offense!

Delighted to report another true landmark appellate victory, this one definitively shaping the law concerning homeowners' challenges to municipal real property tax assessments!

Associate Justice Lara J. Genovesi's 14-page Opinion provides homeowners with a powerful analytical tool with which to challenge tax assessments and, while the lower courts had been hopelessly split on this point, leaves no doubt that the law in this judicial department is now settled.

Kudos to our friends at Maidenbaum and Sternberg, who continue to fight the good fight for New York's homeowners!
