Pleased to share this recent victory, clarifying when a property owner is responsible for accidents/injuries occurring within a sidewalk tree well. Essentially, because maintaining a tree well is the City's responsibility, the adjoining landowner will not be liable unless the plaintiff demonstrates a TIOF as to the landowner's creation, negligent repair, and/or special use.

Reversal!

Delighted to report another reversal won for our friends at Dell & Dean! This is our fourth reversal in two weeks!

This one reinstated Plaintiff's Labor Law claim, rejecting the defendant's "integral to the work" defense. Once again, we've succeeded in turning a dismissed case into a valuable claim for our clients.

Delighted to win our third reversal in a row!

This one is definitely bookmark-worthy for those engaged in Surrogate’s Court practice. The reinstatement of the undue influence objection is particularly noteworthy here, as the petitioner is an attorney who previously assisted the decedent in litigation, held a power of attorney for the decedent, and communicated directly with the will drafter.

The appellate court found that these facts gave rise to triable issues of fact as to whether the petitioner had a confidential relationship with the decedent and whether the ex*****on of the will was the product of the petitioner’s undue influence.

Sound The Victory Horn!

Here’s another reversal and reinstatement won for our friends at Dell & Dean! This one highlights the importance of a full-throated, attacking appellate presentation as it was won on the twin arguments that the motion court had awarded summary judgment based upon a defense that was not properly before the court and, furthermore, that the defendant had substantively failed to meet its prima facie burden in this “missing handrail” case.

In March Madness parlance, this is the appellate equivalent of a full-court press!
