⚖️ MEET VIKTORIA CHERNOVA - AN IMMIGRATION ATTORNEY WHO UNDERSTANDS YOUR JOURNEY

Behind every immigration case is a person facing important decisions about their safety, family and future. For Viktoria Chernova, understanding the human side of immigration law is an essential part of representing her clients. 🤝

🎯 Having personally experienced the immigration system, Viktoria understands the uncertainty and stress that can come with difficult immigration proceedings, including asylum applications, detention and deportation defense.

🎓 Her legal education began at Kazan Federal University, where she earned a degree in Constitutional Law. She later continued her studies at Chicago-Kent College of Law, completing a master's degree focused on trial advocacy.

💼 Viktoria also gained valuable experience during a six-month internship with the Cook County State's Attorney's Office, working in the Financial Crimes and Public Corruption Unit. This experience strengthened her skills in case preparation, legal analysis and courtroom strategy.

🤝 For more than two years, she worked alongside immigration attorneys at the Children's Legal Center, representing immigrant children and families navigating complex legal challenges.

Today, Viktoria focuses primarily on asylum cases, deportation defense and immigration detention matters, including bond hearings for individuals seeking release from detention. ⚖️📄

🚨🇺🇸 EMPLOYMENT-BASED GREEN CARD BACKLOG TOPS 1.2 MILLION

A new analysis of U.S. immigration data shows that the employment-based Green Card backlog has grown to more than 1.2 million people. 📊📄

According to an analysis from the National Foundation for American Policy (NFAP) cited by the Cato Institute, the backlog in the first three employment-based categories reached an estimated 1,264,495 people by December 2025 - a 20.6% increase compared with April 2020.

💼 Why is the backlog growing?

U.S. law currently allows 140,000 employment-based Green Cards per year, and that number includes eligible spouses and children of the principal applicants.

At the same time, demand for employment-based immigration has continued to exceed the number of available Green Cards. Country-based limits also contribute to significantly longer waits for applicants from countries with high demand, particularly India and China. 🇮🇳🇨🇳⏳

📌 The waiting times can be extremely long.

The NFAP analysis estimates that an Indian national with an employment-based case filed in 2026 could potentially face waits of approximately 179 years in EB-2, 38 years in EB-3, and 5 years in EB-1, based on current conditions and the August 2026 Visa Bulletin. These are estimates, not guaranteed individual timelines.

For China, estimated waits for certain 2026 filings could reach 25 years in EB-2 and 7 years in EB-3. 🇨🇳

⚠️ What does this mean for applicants?

Long backlogs can affect not only workers, but also their families and long-term immigration planning. For many employment-based immigrants, the journey to permanent residence can take years - or even decades.

Employment-based immigration is a complex process, and each case depends on factors such as the employment category, priority date, country of chargeability and current visa availability.

A onda, godinama kasnije, stigne poziv:

🚨 U.S. VISA SCREENING EXPANDS TO MORE APPLICANTS

Starting October 1, 2026, the U.S. Department of State will expand its online presence review to additional nonimmigrant visa categories, including I, TN and TD visas. 📱🔍
Applicants for these visas will be instructed to set the privacy settings on all of their social media profiles to “public” or “open” to facilitate the screening process.

🎯 Who is newly affected?

📰 I visa – representatives of foreign media
💼 TN visa – qualifying professionals from Canada and Mexico under USMCA
👨‍👩‍👧 TD visa – eligible dependents of TN visa holders

This review is being added to a screening system that already covers several other visa categories, including F, M, J, H-1B, H-3, K, Q, R, S, T and U, as well as certain diplomatic and official classifications. (travel.state.gov)

🔎 What does the review involve?

The Department of State says consular officers may consider available information during visa screening and vetting when determining whether an applicant is eligible for the requested visa and whether any inadmissibility concerns apply.

⚠️ This does not mean that every applicant will be denied because of something found online. Visa applications are evaluated individually, and applicants must demonstrate that they qualify for the visa they are requesting.

📌 If you are applying for an I, TN or TD visa, the October 1 change is important to understand before your application or interview. Make sure you know what information may be reviewed and how the updated screening process could affect your case.

🇺🇸 Immigration rules continue to evolve. Staying informed and getting case-specific legal guidance can make an important difference.

🚨$100,000 H-1B PAYMENT EXTENDED FOR ANOTHER YEAR🚨

A new Presidential Proclamation issued on September 18, 2026 extends the entry restriction affecting certain H-1B workers for another 12 months, through September 21, 2027. 💼⚖️

💰 What does this mean?

The measure applies to certain H-1B workers who are outside the United States and seeking entry based on a covered H-1B petition. In these cases, the employer generally must make a $100,000 payment, subject to limited exceptions.

Employers are also required to keep documentation of the payment, while the Department of State and DHS are directed to verify compliance during the immigration process. 📄🔍

⚠️ But there is an important legal development.

The original 2025 policy has been challenged in federal court, and a lower federal court vacated the fee requirement. An appeals court has not reinstated the fee, meaning the $100,000 payment is currently subject to ongoing litigation and is not simply a requirement that every H-1B worker must pay.

📌 Who is affected?

This is not a $100,000 charge for every H-1B worker. The proclamation specifically targets certain H-1B beneficiaries who are outside the United States and need admission to the country. It also allows DHS to make exceptions when it determines that hiring particular workers is in the national interest.

⏳ With the policy extended through September 2027 and court proceedings continuing, employers and H-1B professionals should closely monitor developments before making important immigration decisions.

🇺🇸 Every H-1B case is different. Understanding how the current rules and court decisions apply to your situation is essential.

✈️ DA LI BISTE DANAS PONOVO IZABRALI SAD?

Kada ste prvi put krenuli preko okeana, verovatno niste mogli da znate kako će izgledati život koji vas tamo čeka. Novi grad, novi ljudi, drugačiji sistem, posao, jezik i potpuno novo životno iskustvo. 🌎

SAD?
🌍 Neku drugu zemlju?
✈️ Ako biste birali drugu zemlju - koju i zašto?

💬 Pišite nam u komentarima! Vaše iskustvo možda može da pomogne nekome ko tek razmišlja o odlasku u inostranstvo i pokušava da zamisli kako izgleda život nakon prvog koraka. 👇

🎓 GOOD NEWS FOR F-1, J-1 & I VISA HOLDERS

A major immigration rule affecting international students, exchange visitors and foreign media representatives has been temporarily blocked by a federal court. ⚖️🚫

The Department of Homeland Security (DHS) had planned to replace the long-standing “Duration of Status” (D/S) system with fixed periods of admission beginning September 15, 2026. However, on September 14, a federal judge issued a preliminary injunction, preventing the new rule from taking effect while the legal challenge continues.

📌 What does this mean right now?

For the time being, the existing D/S framework remains in place. Eligible F-1 and J-1 students and exchange visitors can continue to remain in the United States for the duration of their authorized program, as long as they maintain their immigration status and comply with applicable requirements. 🎓📚

The blocked rule would have introduced fixed admission periods, generally capped at four years for F and J classifications, required certain individuals to file extension-of-stay applications with USCIS, and introduced additional restrictions affecting students and exchange visitors. I visa holders would also have faced fixed admission periods, including a 240-day limit in many cases.

⏳ For F-1 students, the current 60-day grace period after completing a program remains in place under the existing framework. The court's order is preliminary, however, and the litigation is still ongoing.

⚠️ Important: This is not a final decision on the rule. The administration may appeal, and further court action could change the situation.

If you hold F-1, J-1 or I status, staying informed and understanding how the current rules apply to your individual circumstances is essential. 🇺🇸⚖️
