On October 30, 2025, the judge in ASAP members’ lawsuit ruled that no asylum seekers are currently required to pay the annual asylum fee. However, this pause is temporary, and if your asylum application has been pending for more than 1 year, you may be required to pay the fee soon. DHS Ends Automatic Extension of Employment Authorization

If you file to renew your EAD (work card) on or after Oct. 30, 2025, you will no longer receive an automatic extension with the limited exception of TPS-related. USCIS recommends to file for renewal up to 180 days before their EAD expires to prevent a temporary lapse in employment authorization or documentation.

The Department of Homeland Security has announced an interim final rule ending the practice of automatically extending employment authorization documents for aliens filing renewal applications in certain employment authorization categories.

All applicants with a pending Form I-589 for Asylum will now pay a yearly annual asylum fee of $100 for asylum applications pending for more than one year.
