You move your things into your brother's spare room, and at 2 a.m. the fear hits: leaving just handed her the kids and the house.

New York's custody standard doesn't work that way. There is no prima facie right to custody in either parent. The court weighs what actually serves your child's best interests.

What actually costs people ground is walking out without anything in writing about the parenting schedule, who's covering which bills, or how the house gets used. Attorneys frequently find that cases arrive weaker simply because nobody documented the real routine once someone moved out, and six months later it's just two people remembering the same fall differently.

New York doesn't hand you a default school-year custody schedule just because September rolled around. There's no checklist a judge runs through. If you want drop-off on Mondays and pickup on Fridays locked into an order, you have to show how that schedule serves your kid's routine, not just what feels fair.

More often than not, what I see is a fall schedule that only ever existed as text messages since September. No calendar. No log of who had the kids on which days. By December, both parents remember that fall differently, and there's nothing solid to hand a judge.

Three days before your preliminary conference, your lawyer asks for three years of tax returns. All you've got is this year's.

In a Brooklyn Supreme Court divorce, the Statement of Net Worth has to be sworn, exchanged with the other side, and filed at least 10 days before that conference. It carries three years of tax returns, W-2s or 1099s for any year you didn't file returns, and statements from every account you hold, right down to the ones you forgot existed.

What attorneys often see is a plaintiff's case already sitting behind before the first hearing, because the business records stop short, the account statements are stale, or nobody pushed for a real valuation early enough.

The will naming you as executor isn't what the bank is waiting for. In New York, the authority comes from Letters Testamentary or Letters of Administration, issued by the Surrogate's Court. Those papers are the conclusive proof that you can reach an account, sell the house, or pay estate bills out of estate money.

There are narrower paths. If the estate is personal property worth $50,000 or less, a Voluntary Administration may settle it without letters, though it can't transfer real estate. Banks also often keep their own internal policies for small accounts, and that dollar cutoff varies widely from one institution to the next.

Your mother's "important papers" folder holds a photocopy of dad's will. Nobody's sure where the original went. Maybe the lawyer's office that closed years ago. Maybe a drawer nobody's opened since.

Kings County Surrogate's Court needs the original will to open a probate case, plus a certified death certificate, the Petition for Probate, and the Oath and Designation of Executor, along with two copies of everything and a filing fee tied to the estate's value.

If that will was last known to be in dad's hands and it can't be found, New York presumes he destroyed it himself. Beating that presumption takes clear and convincing proof, and the will's terms still need two credible witnesses or a verified copy to back them up.

September brings crossing guards back to their corners, buses double-parked, and cars turning through crosswalks full of kids in new backpacks. It's also when pedestrian strikes near schools start climbing, right where traffic is supposed to slow down.

A police report gets filed if it happens to you or your child, but it generally isn't dispositive proof of fault. An officer's conclusions about fault are typically excluded in civil cases, so the report often can't carry a case alone. What builds the case is what gets photographed fast.

That documentation also decides whether you clear New York's serious injury threshold. A fracture qualifies. So does an injury that prevents substantially all of a person's usual and customary daily activities for at least 90 of the 180 days after the accident.

In New York, a police report generally isn't proof of who caused a crash. It records what an officer saw at the scene, and an officer's opinion on fault is typically kept out of a civil case. That report alone often can't carry your claim.

What actually closes that gap is what gets grabbed in the first few days: photos of the damage and the road, a witness's number before she disappears into the crowd, the clothes you had on. From there, an attorney can push to preserve the car's black box data and phone records before anyone has a reason to lose them.

Your supervisor asks when you're back full-time, and it hits you that your insurance company hasn't received a single piece of paper from you.

In New York, the form that turns on your no-fault benefits has a name: the Application for Motor Vehicle No-Fault Benefits, the NF-2. It goes to the insurer by mail or electronically within 30 days of the crash. That filing is what starts payment for medical bills and lost wages while you're out of work.

Thirty days from the accident. Not from when the bills show up.

Miss that window and you're arguing for an excuse instead of filing a claim. Late filing can be excused if it wasn't reasonably possible to file on time, but you have to show that and get the proof in as soon as you reasonably can.

Every July, the scaffolding along Court Street turns into a second ceiling, and the crews underneath push hard to hit deadline before winter. That's usually when someone takes a bad step off a plank, decides he's fine, and finishes the shift instead of telling anyone.

That costs more than pride. In New York, protecting a Workers' Compensation claim means giving your employer written notice within 30 days of the accident. Miss that window and the claim can get denied before it starts.

If a dangerous condition on the job site caused the fall, there's often a separate claim against the general contractor or property owner. No fixed deadline applies there, but the sooner it's reported, the sooner there's a record of who saw what. Waiting doesn't cost you a filing date. It costs you the account nobody wrote down.

A friend from work means well when she tells you to just call the store's insurance company back and get it over with. Be honest, be quick, move on with your day.

In New York, you're generally not required to give a recorded statement to the property owner's insurer while your slip-and-fall claim is still open. That call isn't small talk. It gives the adjuster material to work with, on the record, before you've had a chance to think any of it through.

New York also lets you recover damages even if you were partly at fault for the fall, wet floor and all, but your compensation gets reduced by whatever percentage of fault they can pin on you. A recorded statement given early is often the exact evidence used to argue for a bigger share of that blame.
