H-1B Lottery Starts on March 7, 2025.

USCIS announced today that the initial registration period for the H-1B lottery will open at noon Eastern on March 7 and run through noon Eastern on March 24, 2025. Employers or their representatives must use a USCIS online account to register each beneficiary electronically for the lottery and pay the associated registration fee of $215 for each beneficiary.
The results are expected by the end of March 2025.

USCIS is now accepting applications for Parole-in-Place

On August 19, 2024, USCIS started accepting Parole in Place applications from eligible individuals. The application, Form I-131F, can only be filed online. The filing fee is $580, and no fee waivers will be accepted.

In order to qualify you must:

- Be present in the United States without admission or parole.
- Have been continuously physically present in the United States since at least June 17, 2014.
- Have a legally valid marriage to a U.S. citizen on or before June 17, 2024.
- Have no disqualifying criminal history and otherwise not deemed to be a threat to public safety, national security, or border security.
- Submit biometrics and undergo required background checks and national security and public safety vetting.

Stepchildren of U.S. citizens must:

- Have been under the age of 21 and unmarried on June 17, 2024.
- Be present in the United States without admission or parole.
- Have been continuously physically present in the United States since at least June 17, 2024.
- Have a noncitizen parent who entered into a legally valid marriage with a U.S. citizen on or before June 17, 2024, and before their 18th birthday.
- Have no disqualifying criminal history and otherwise not deemed to be a threat to public safety, national security, or border security.
- Submit biometrics and undergo required background checks and national security and public safety vetting.

Once the Parole-in-Place is granted, an immigrant will be able to file a marriage based green card without leaving the United States.

USCIS will conduct a second random selection for H-1B visas from previously submitted H-1B registrations. No further action is needed – the applicants that were not selected in March 2024 will be automatically included in the new round of the lottery.

New Parole-in-Place Law - USCIS will begin accepting applications on Aug. 19.

USCIS has announced that on August 19, 2024 it will begin accepting applications under president Biden new policy for certain immigrants married to U.S. citizens to adjust their status.

Eligibility Requirements:

To benefit from these changes, individuals must meet the following criteria:

• Be present in the United States without admission or parole;
• Have been continuously present in the United States for at least 10 years as of June 17, 2024;
• Have a legally valid marriage to a U.S. citizen as of June 17, 2024;
• Not have any disqualifying criminal history or otherwise constitute a threat to national security or public safety; and
• Otherwise merit a favorable exercise of discretion.

New Immigration Law Changes Announced for Spouses of U.S. Citizens

President Biden has announced significant changes to U.S. immigration laws, introducing a new pathway for certain immigrants married to U.S. citizens who entered the country without formal inspection.

Key Eligibility Requirements:

- Residency Requirement: Individuals must have been in the U.S. for at least 10 years as of June 17, 2024.

- Marital Status: Must be married to a U.S. citizen by June 17, 2024.

- Legal Qualifications: No disqualifying criminal records or immigration violations.

Moreover, stepchildren of U.S. citizens will qualify under these changes if the marriage to their parent was in place by June 17, 2024.

H-1B Lottery extended until March 25, 2024 (12:00 PM EST).

Due to technical issues on the USCIS H-1B portal, the initial March 22, 2024 deadline is extended until Monday.

USCIS still intends to complete the selection process by March 31.

USCIS has announced that this year the H-1B lottery registration opens March 6th at 12 P.M. EST and ends on March 22nd at 12P.M. EST.

The lottery registration can be only done online via a new USCIS portal that will become available by 12 PM EST on February 28, 2024.

USCIS Premium Processing Fee Increase Reminder

Effective Date: February 26, 2024.

Reminder: all premium processing Form I-907s postmarked on or after February 26, 2024, will be subject to the new fee schedule. The premium processing fee will increase to $2,805 for Form I-140 petitions and most Form I-129 petitions, up from the previous $2,500. For eligible Form I-539 applications, the new premium processing fee will be $1,965, and for Form I-765 (OPT applications), the fee will be $1,685.
