🚨 Important Update for DACA Recipients in Immigration Court

A new decision from the Board of Immigration Appeals in Matter of Santiago changes how DACA is treated in deportation (removal) proceedings.

What changed?
Having DACA alone is no longer enough for an immigration judge to terminate your case.

What this means:

DACA still provides work authorization and temporary protection
But it is not a legal basis to dismiss your case
Judges must now evaluate the legal reasons for termination and consider whether the Department of Homeland Security (DHS) objects

Why this matters:
If you have DACA and are in immigration court, your case may continue forward unless there is another legal pathway available.

What you should do:
✔️ Keep your DACA active and renewed
✔️ Speak with an immigration attorney about long-term options
✔️ Do not assume DACA will “pause” or end your case

Update on Termination of Temporary Protected Status for Syria
The TPS designation of Syria and related benefits was set to terminate on Nov. 21, 2025. However, on Nov. 19, 2025, the U.S. District Court for the Southern District of New York issued an order staying the TPS Syria termination. Dahlia Doe v. Noem, 25-cv-8686 (S.D.N.Y.).

TPS Syria beneficiaries will keep their status and employment authorization, and their documentation will remain valid per the court order. Forms I-766, Employment Authorization Documents (EADs) with category A12 or C19 remain valid and are extended. Refer to the EAD Extension dropdown on the TPS Syria page for EAD expiration dates that are extended pending the resolution of the litigation.

SAVE will verify if an alien has received an approval for TPS that has not been withdrawn using information from any TPS-related document, such as a Form I-797, Approval Notice, or Form I-797C, Notice of Action. TPS beneficiaries will receive a SAVE manual response of:

“Temporary Protected Status – Employment Authorized - Temp Emp Auth”;
The employment authorized through date will be the Employment Authorization Document (EAD) expiration date of “March 13, 2026"; and
DHS Comments “TPS and employment authorization are extended per court order. Please check the USCIS TPS Syria page regularly for updates.”
As this matter is in active litigation, the status of the individual's TPS and employment authorization is dependent on developments in the litigation. Update on Termination of Temporary Protected Status for Burma
The TPS designation of Burma and related benefits terminated on Jan. 26, 2026. However, on Jan. 23, 2026, the U.S. District Court of the Northern District of Illinois issued an order postponing the TPS Burma termination. Aung DOE et al. v. Noem et al., No. 25-cv-15483 (N.D. Ill.).

TPS Burma beneficiaries will keep their status and employment authorization, and their documentation will remain valid per the court order. Forms I-766, Employment Authorization Documents (EADs) with category A12 or C19 remain valid and are extended. Refer to the EAD Extension dropdown on the TPS Burma page for EAD expiration dates that are extended pending the resolution of the litigation.

📣 H-1B UPDATE: FY 2027 REGISTRATION OPEN

USCIS announced that the initial registration period for the FY 2027 H-1B cap opened on March 4, 2026 and runs through March 19, 2026 (12:00 PM ET). During this period, employers must submit electronic registrations through a USCIS online account for each prospective H-1B worker.

• Registration fee: $215 per beneficiary
• USCIS expects to issue selection notices by March 31, 2026.

Employers may only file a full H-1B petition if the beneficiary’s registration is selected in the lottery.

📣 ACTUALIZACIÓN H-1B: REGISTRO FY 2027 ABIERTO
