Mr. Bowens (pictured with our Chief of Legal Staff, Patrick) hired our firm to prepare and file a Motion for Relief from Judgment on behalf of his brother because he heard nothing but good things about the Moffitt Law Firm. After meeting with Patrick and discussing his brother's case, he said he is happy to be putting his trust in us to provide his brother with the best representation possible. The clerk at this gas station claimed that she could identify this gunman as our client, Lafayette Upshaw, even though she admitted that she could only see the gunman's eyes. Upshaw's aunt says Upshaw was home with him at the time of the robbery, but the jury never heard her statement because Upshaw's trial attorney failed to call her to testify at trial. The jury found Upshaw guilty and sentenced him to 20-40 years in prison. Last week, Judge Linda Parker granted him a new trial based on our briefs and arguments.

In honor of our late, great Mr. Moffitt, our law firm stays WINNING! 7-14-22: Federal Court Judge Linda V. Parker orders a new trial on behalf of our client, Lafayette Upshaw. In her opinion, Judge Parker adopted many of the same arguments we made in our initial Habeas Petition on behalf of Mr. Upshaw. The State now has only 120 days to give Mr. Upshaw the new trial he so justly deserves or release him from custody. All of the attorneys and paralegals here at the Law Offices of David L. Moffitt & Associates, PLLC could not be more proud of this win. We will NEVER stop fighting for JUSTICE!
