MO DWI EXPUNGEMENTS & CLEANING UP YOUR CRIMINAL RECORD FOR A BACKGROUND CHECK

What are the consequences of a DWI in MO:

A Missouri DWI (driving while intoxicated) or DUI (driving under the influence) or BWI (boating while intoxicated) arrest can have serious repercussions and long lasting consequences that can follow a person around for the rest of their life. A DWI arrest usually results in the filing of a criminal case charge against you in Municipal, State or Federal Court. Most people also face a separate licensing action through the Department of Revenue that could result in the suspension or revocation of their driver’s license. These types of charges can result in obvious repercussions such as expensive legal fees, court fines, jail time, license points, license suspension or revocation, SATOP class time and costs, ignition interlock costs, probation time and costs, increased insurance rates and SR-22, community service and in some cases even job loss just to name a few. These types of charges can also result in long lasting consequences that impact your permanent record and that will appear on a background check. (See my blog “DWI CONSEQUENCES & PENALTIES” for a more comprehensive explanation of the Consequences & Penalties of a DWI in MO)

What is my “record” & If my first time DWI resulted in probation will I still have a record:

The long lasting consequences that a DWI charge can have on a person’s permanent record are often misunderstood. A person’s complete “record” is comprised of several components including, a criminal record of pleas and convictions, an arrest record, a driving record, a publicly viewable online case history system, and sometimes various forms of “closed records”** Clients that have had a prior DWI charge often tell me they believe that they have “no record” from their prior DWI and that their prior attorney told them that if they successfully complete probation it would be as if “the DWI never happened.” Unfortunately the truth is more complicated than that.

It is true in MO that if a person charged with a DWI successfully completes an SIS Probation then they do not end up with a “conviction” on their record, however a person’s “record” is comprised of more than just whether or not they have convictions. Despite the fact that a successful SIS probation does avoid a conviction, there is still a “plea of guilty” that is made in court that will be a part of your record going forward. Also, the SIS probation plea does not remove the DWI arrest from a person’s arrest record. It also does not remove any DWI breathalyzer related license suspension from a person’s driving record. If that same person refused the breathalyzer and filed a “Petition for Review” lawsuit to obtain a “confession” that prevented the 1 year revocation (chemical action) of their driver’s license that still does not remove the lawsuit from the publicly viewable online case history system. Lastly, a background check performed by the MSHP will still show that the DWI was disposed of an SIS probation outcome. Due to the fact that so much of your “record” will still reveal that the prior DWI occurred, even after an SIS probation plea, it is wholly inaccurate to believe that it is “as if the DWI never happened.” Further, if a second DWI arrest occurs, a prosecuting attorney can and will in fact consider it as a “second DWI” for purposes of enhancing criminal penalties.

Can a DWI be expunged in Missouri – Am I eligible for a DWI expungement:

Yes, under certain circumstances a DWI can be expunged in Missouri if you meet the eligibility requirements under RSMo 610.130. Only a FIRST time intoxication related traffic or boating offense may be expunged. A period of ten (10) years must have elapsed since the date of that first intoxication related traffic or boating offense plea or conviction. The offense must have been either an ordinance violation or a misdemeanor – you cannot have a felony offense expunged. The individual must not have been convicted of any subsequent intoxication related traffic or boating offense since the date of the conviction or plea of the offense that they are seeking to have expunged, and they must not now have any intoxication related traffic or boating offense pending. Offenses for driving a commercial vehicle under the influence of alcohol are not eligible for expungement, and individuals with a commercial driver’s license are not eligible for an expungement. A person is eligible for only one expungement of this nature.

How do I get a DWI expungement in Missouri & What does it mean to get a DWI expungement:

In order to get an expungement in MO a petition (lawsuit) must be filed in the Court of the County where the DWI plea, conviction or sentence occurred. There is a filing fee paid to the Court at the time of filing the Petition. Most people hire a lawyer to represent them and file the Petition with the Court. All entities that possess any records related to the DWI offense should be named and served summons in the lawsuit which will bring those entities under the jurisdiction (control) of the court. The applicant will be required to complete a fingerprinting card and file it with the court. The court will set a hearing date, the applicant will testify at the hearing and the Judge will make a determination about expungement eligibility. If eligible the Court will issue an Order compelling each entity to expunge all records related to the offense. This will result in all records and files in the care and custody of each entity becoming confidential records that will only be accessible to third parties by order of the court for good cause shown. The effect of this Order is to restore the person to the status that they held prior to the arrest, plea and conviction as if the offense had never taken place. Therefore, once the expungement is granted, a background check and/or driving history from that point forward will not show any arrest, plea of guilty, conviction, probation, licensing suspension or revocation and any case history information will be removed from the online publicly accessible court case system.

**Closed records generally can only be accessed by third parties with your consent or a court order and good cause shown. There are narrow exceptions that go beyond the scope of this writing. There are different types of background checks, but most background checks for employment purposes will look into all components of a person’s record, sole exception being “closed records” unless the individual has signed a consent to access closed records.

MO CDL holders - Why is it critically important to hire a lawyer that thoroughly understands and regularly deals with the CDL laws at both the MO state and federal level to handle traffic tickets received while driving ANY type of vehicle? There is a lot to understand in order for a lawyer to effectively represent a CDL holder as a client. Failing to hire the right lawyer can cost a CDL holder dearly.

CDL holders have to worry about more than just whether or not any given traffic violation can result in points against their MO driver's license. CDL holders need to be concerned not only about MO D.O.R. driving record points but also about their FMCSA’s CSA score/points. Additionally, aside from points in MO and CSA points, a CDL holder also needs to be concerned about whether any given traffic violation is classified as "serious CDL violation" that can result in a CDL disqualification without the accumulation of a certain number of points. If your lawyer doesn't understand the details of the intersection of these laws they are probably not a good fit to represent a CDL holder effectively.

What is the FMCSA and CSA scores? The FMCSA (Federal Motor Carrier Administration) applies to all commercial licensed drivers that drive interstate, its mission is to prevent commercial vehicle crashes. The FMCSA's enforcement program is called the CSA (Compliance, Safety & Accountability) program, the CSA uses the SMS (Safety Measurement System) measurement tool to identify drivers with safety problems based upon their road performance and investigation results and then organizes the data into 7 basic categories. Every driver has a "CSA score". The CSA can take take actions/interventions against drivers, which can be warning letters, roadside inspections, investigations. Most CSA points violations only apply concerning driving in a commercial vehicle, however some more serious traffic safety related violations can result in CSA points when received while driving any type of vehicle. A driver can contact the FMCSA to inquire what the impact will be for any given charge concerning your CSA score, and you can check your current CSA score on their website online.

A CDL holder should have a lawyer that understands the nitty gritty details to help protect their license. For example most lawyers that do not have a mastery of all of the CDL related laws might believe that if their CDL client receives a ticket for speeding 10mph over in their commercial vehicle, and they obtain an amendment of that charge to "defective equipment" that they have gotten them a "great deal" that protects their client's CDL from all harmful repercussions - but they'd be wrong. It is true that in MO a conviction for “defective equipment” will result in no points with the D.O.R against that client's driver's license. However the FMCSA further classifies “defective equipment” into sub-types and depending on the FMCSA's classification of any given conviction can result in as many as 10 CSA points against that client's CDL CSA score. There are numerous violations in MO that if convicted do not result in points on your MO driver's license but do however result in CSA points against your CDL. You should have a lawyer that knows the difference.

WHAT IS MISSOURI'S NEW LAW ON "ELECTRONIC COMMUNICATION DEVICE" (ECD) USAGE WHILE OPERATING A VEHICLE - Law takes effect 8/28/2023 - RSMo 304.822

BASIC OVERVIEW OF THE LAW (nuts and bolts details of the law are provided further below) :

The law is effective 8/28/23 but non-commercial drivers can only be issued warnings for violations until 1/1/25. As of 1/1/25 violations can be an Infraction, Misdemeanor or a Felony depending on the circumstances of the violation. Operators of commercial and noncommercial vehicles cannot hold, read, view or use an electronic communication device (phones, tablets, laptops, beepers, tv's, video screens etc.) while driving unless lawfully stopped (red light) or parked. There are limited exceptions for hands free and voice activated devices. There are limited exceptions for certain types of special operators and certain special circumstances. The law applies broadly to all public roads, highways, interstates (or the like, etc.) located within MO and applies to any other property held open regularly to the public for vehicular traffic. Noncommercial operators have the right to decline an officer's request to search or seize your electronic communication device. A warrant can only issue for search and seizure if the violation resulted in serious bodily injury or death. No operator can be stopped or detained solely for violation of only this law.

NUTS & BOLTS OF RSMO 304.822:

What is an "electronic communication device" (ECD) under this law? A portable device used to initiate, receive, store or view communication, information, images or data electronically. This specifically DOES include, but is not limited to: cell phones, tablets, pagers, laptops, gaming systems, video players, tv's, or similar devices. This does NOT include: radios, commercial 2 way radios, subscription based emergency communication devices, prescribed medical devices, GPS receives, security, navigation, communication systems permanently affixed to the vehicle.

In what locations does this law apply? Within MO on any "highway" (public thoroughfare for vehicles, state roads, county roads, public streets, avenues, boulevards, parkways, or alleys) or property open to the public for vehicular traffic.

Who does this law apply to? This law applies to all operators of any commercial or noncommercial motor vehicle, HOWEVER except the law does NOT apply to the following persons/situations: 1) law enforcement using ECD in their official duties; 2) operators using ECD to report an emergency; 3) operators of noncommercial vehicles using ECD solely via voice operated or hands free feature; 4) operators of commercial vehicles using ECD via voice operated or hands free feature only when remaining seated & in a seatbelt; 5) operators of commercial vehicles reading a message displayed in a permanently installed communication device with a screen not exceeding 10" x 10"; 6) operators using ECD that are lawfully stopped or parked; 7) commercial vehicles responding to request for roadside assistance through a motor club or towing company; 8) ECD used to relay information between transit or for-hire vehicle operators and that operator's dispatcher so long as the device is mounted to the vehicle; 9) ECD used to access or view a map for navigation; 10) ECD used for listening to audio broadcast or digital audio recording; 11) ECD used to relay information through a transportation network company's digital network to a transportation network company driver so long as the device is mounted to the vehicle.

What activity is banned under this law? 1) no operator may physically hold or support, with any part of their body, an ECD; 2) no operator may write, send, or read any text message, instant message, email, or social media interaction on an ECD (unless using voice operated or hands free feature AND not diverting your attention from operating the vehicle) ; 3) no operator may make any communication on an ECD, including a phone call or voice message (unless using voice operated or hands free feature); 4) no operator may engage in any form of electronic data retrieval or communication on an ECD; 5) no operator may manually enter letters, numbers, or symbols into any website, search engine or app on an ECD; 6) no operator may watch a movie or video on an ECD (unless watching data related to navigation of the vehicle); 7) no operator may record, post, send, or broadcast video, or participate in a video conference (unless it is an electronic device used for the sole purpose of continually monitoring operator behavior by recording or broadcasting video within or outside the vehicle).

What is the penalty for violating this law? Violation can be an Infraction, Misdemeanor or even a Felony depending on the circumstances of the violation: 1) Infraction: Violation with no property damage or injury involved is an "Infraction". Penalties for Infraction violation: Fine up to $150 for conviction when there are no prior convictions in the prior 24 months. Fine up to $250 for conviction when there is one prior conviction in the prior 24 months. Fine up to $500 for conviction when there are two or more convictions in the prior 24 months. Fine up to $500 for conviction for violation in a work zone with workers present, or in a marked school zone; 2) Class D Misdemeanor: Violation that was proximate cause of property damage in excess of $5,000 shall be a Class D Misdemeanor; 3) Class B Misdemeanor: Violation that was proximate cause of serious physical injury to another person shall be a Class B Misdemeanor; 4) Class D Felony: Violation that was proximate cause of death to another person shall be a Class D Felony; 5) Violation while operating a Commercial Vehicle shall be deemed a "serious traffic violation" for purposes of a CDL disqualification under 302.755.

What are your "Rights" concerning violation of this law and/or a law enforcement officer's request to search or confiscate your ECD as a result of violation of this law: 1) An Officer is REQUIRED to inform any noncommercial operator that he has a right to decline a search of their ECD; 2) No warrant shall be issued for search or confiscation unless the violation resulted in a serious bodily injury or death; 3) violation of this law alone shall not be used as probable cause for any other violation; 4) No operator shall be stopped, inspected or detailed solely for violation of this law; 5) No noncommercial operator shall be issued a citation for violation of this law prior to 1/1/2025, but instead shall be issued only a warning prior to such date.
