I’ve been working with do it yourself estate planning messes more frequently. Even people using AI to create documets for them. I can only imagine in 15 years how many estates will be in probate litigation because things weren’t done correctly.

I am a do it yourself guy. Willing to learn and try anythjng as long as the risk isn’t too great. When it is, I’m happy to hire a professional.

Its nearly as important to understand how your various estate planning documents function together in addition to what each document contains.

The distinction between Trustee, Executor, and Agent is important to understand.

We have been getting questions about homeowners insurance and a Living Trust. The recent fires have people concerned that insurance coverage may be affected if a home it titled in a trust.

While I have not heard of anyone being denied personally because of this, I recommend contacting your insurance company and informing them of your trust. It should be possible to add the Trust as an additional insured on your existing policy without too much difficulty.

You may be asked for a Certification of Trust to provide the essential trust details.

California just passed a law (AB2016) allowing you to pass your primary residence valued up to $750,000 without a trust or probate. This may work for a few people, but is totally useless for others. (Will your home be over $750k at your death?)

I haven't worked with the new process, but it still involves filing a petition with the court and court oversight.

The legislature tried years ago to create an alternative to trusts with the Transfer on Death deeds. They work in very limited circumstances but not for most.

I still think most of us need a complete estate plan with a Trust. Private, inexpensive, and fast administration without government interference.

Do you remember voting to pass Prop 19 a few years ago? It severely restricts the ability to avoid property tax reassessment when property passes to your kids. Are you going to be able to keep inherited property? Are yourkids?

Brentwood police have recovered most of the items stolen from my office. I’m grateful for their response, and my camera footage did the trick. But I still assert that we have a societal problem with drugs and crime that needs real solutions. Not just lock them up. Not just let them go. And I don’t believe the government can handle the task. Gavin is never ready for change unless it lines preferred pockets.
