HSB congratulates attorney Stewart Schneider who reached a milestone as head of the firm's Title Curative Department. The firm has now resolved title issues involving over 1,000 properties in Missouri either by way of litigation or cooperation of the parties!

HSB congratulates attorneys Trent Bond and Grant Mabie on their win at the Missouri Court of Appeals. Trent and Grant represented a business owner in a lawsuit and later appeal which was brought after the parties had settled an earlier partition suit over real property they owned together. Trent and Grant moved to dismiss the lawsuit because it involved claims for damages that could have been raised in the earlier partition suit. The trial court agreed and dismissed the case. The trial court’s order was later upheld on appeal.

HSB congratulates attorneys Trent Bond and Bradley Mitchell on their summary judgment win in the Circuit Court of Lincoln County, MO. Trent and Brad represented the purchaser of property in an action seeking to set aside a foreclosure sale and to quiet title in Plaintiff's name. Plaintiff brought his claim because he believed that the sale was procedurally improper due to an alleged lack of notice and because Plaintiff, the lender, and a third-party had an alleged preexisting agreement whereby the third-party would purchase the note from the lender to avoid foreclosure. Trent and Brad ultimately moved for Summary Judgment in favor of the foreclosure purchaser. Upon hearing argument, the Court granted the Motion for Summary Judgment determining that Plaintiff not only had proper notice of the sale but was present when the sale was being called. The Court further determined that even had there been some preexisting lender-borrower agreement to sell the note, it was not binding on the foreclosure sale purchaser nor on the subsequent purchasers who now hold title to the property because they had no knowledge of such arrangement.

HSB congratulates attorneys Trent Bond and Grant Mabie on their win at the Court of Appeals. Trent and Grant represented a commercial property owner in a partition suit that was resolved and settled. Later, the other party in the suit brought a new lawsuit claiming rent owed, damage to the property, and breach of fiduciary duty. Trent and Grant moved to dismiss the new lawsuit arguing that the claims were barred under the doctrine known as res judicata because they could have been asserted in the earlier case but were not. The trial court agreed and dismissed the new lawsuit. On appeal, the Court of Appeals affirmed the trial court in all respects finding that all claims between the parties had been fully resolved by the settlement of the earlier lawsuit and dismissal of the new lawsuit was proper.
