What does legal custody mean?

Legal custody is different from physical custody. Physical custody means the child or children live with one person the majority of the time or split their time pretty evenly between two people. Custody can be joint between two people or one person can have sole custody.

Legal custody is the right to make decisions for a child's education, activities, medical and psychological care, religious training, discipline, and summer activities. If two people share legal custody, it is important that they discuss these matters together instead of one person making all those decisions on their own.

I talk to people every week who want to file for an irreconcilable differences divorce. An irreconcilable differences divorce is a "no fault" or "no contest" divorce where both parties agree to the divorce and all issues of property, child custody, child support, and alimony. There are websites that offer forms that claim to be sufficient for Mississippi Courts. There are non-attorneys that will prepare divorce forms for far less than an attorney will provide. There are even AI services that generate divorce forms.

So why should you hire an attorney for your no-contest divorce? Attorneys go through a strict licensing process and are trained in legal research. Only attorneys can offer legal advice or do legal work. Attorneys know which pitfalls to look for and the types of concerns judges will have.

Though it is appealing to get a free or low-cost divorce, those types of divorces usually result in needing modification - a legal process that becomes very costly very fast. Some of the most common reasons for traffic stops:

1. Speeding
2. Lack of license plate or expired license plate
3. Reckless driving (such as swerving, following too closely, driving too fast for weather or traffic conditions)
4. No seatbelt
5. Specialty frame that covers portions of your license plate
6. Improper equipment (like a broken headlight or missing side mirrors)
7. Failure to use turn signals
