Does the higher earner automatically pay alimony in Florida? No.

The court starts with two questions. First, does one party have a need? Then, does the other party have the ability to pay? Only after both are answered does the court look at the type, amount, and duration, and the length of the marriage is one of the factors that can shape that.

Income matters. It just is not the only thing that matters. The full financial picture does too.

What is the mediation process in family law?

Mediation is generally required in a divorce or paternity case. But required does not mean forced. The process is voluntary, which means there's no obligation to sign an agreement at the end.

Here's the usual setup: you and your attorney in one room, opposing counsel and the other party in another, and the mediator going back and forth to try to finalize a parenting plan or settlement agreement and help both sides reach an agreement.

Knowing what to expect can take some of the stress out of it.

Moving money before a divorce does not make it disappear.

In Florida, both spouses must disclose their finances, and a court can account for assets that were intentionally moved or hidden. Honesty protects you. Shady transfers usually surface.

"I paid for the house, so I keep it." Not always true in Florida.

If you owned a home before marriage and later added your spouse to the deed, the law presumes you made a gift to the marriage. Once it is jointly titled, it is generally treated as a marital asset and split between both spouses, regardless of who paid.

A prenuptial agreement is one way to spell out what stays separate before that ever becomes a question. Nobody plans a wedding while picturing a divorce, but these are exactly the conversations worth having first.

What actually makes a divorce "collaborative"?

It's not just a vibe or an attitude. It's a signed contract.

In a collaborative divorce, both spouses and both attorneys sign an agreement promising:
✔️ No motions filed
✔️ No courtroom
✔️ Planned meetings instead
✔️ Neutral experts (financial advisors, parenting coordinators) brought in as needed

And here's the part most people don't realize: if the case can't be settled collaboratively and someone files a petition to litigate, both spouses have to hire brand new attorneys.

That built-in commitment is what keeps everyone at the table working toward resolution.

What does "rebuttable presumption of equal time-sharing" actually mean in Florida?

Under Fla. Stat. § 61.13, if both parents are involved and both request a 50/50 schedule, the law presumes that equal time-sharing is in the child's best interest.

That means the burden shifts. The parent who disagrees must prove, by a preponderance of the evidence, that a 50/50 schedule is NOT in the child's best interests.

In Florida, divorce isn't community property. It's equitable distribution.

What does that mean? Any asset acquired or liability incurred between the date of marriage and the date of filing is generally split 50/50. The court starts with the presumption that marital assets and liabilities should be divided equally.

Could a party ask for an unequal split? Yes, but only in limited circumstances spelled out by statute.
